Nebraska Lawmaker Justin Wayne Pushes for Reform of Drug Laws

A Nebraska lawmaker is pushing for a change in the state’s drug laws that he says are outdated, according to a report in the Lincoln Journal Star. Sen. Justin Wayne of Omaha has introduced two bills that would adjust penalties for some drug possession and distribution offenses. At a meeting of the legislature’s Judiciary Committee on Wednesday, Wayne said current laws were putting people who were not involved in the distribution of drugs in prison for trafficking and creating overcrowding in state prisons and county jails.

The first measure, LB89, was introduced by Wayne in January and would reduce penalties for possession of marijuana and possession with intent to deliver. Wayne told his colleagues on the committee that the state’s current laws are resulting in defendants being sentenced unfairly.

“We have arbitrary numbers in the marijuana statutes that presume a person is a distributor,” Wayne said. “Our law needs to be nuanced because if not … we are prosecuting people who simply may have a habit, although illegal, but are not considered drug manufacturers or distributors.”

Under LB89, possession with intent to deliver five pounds or less of marijuana would be reduced to a Class lV felony. Quantities greater than five pounds would continue to be a Class llA felony, with penalties of up to 20 years in prison.

For simple possession charges, more than one pound up to five pounds of marijuana would be a Class l misdemeanor. More than three ounces to one pound would be a Class lll misdemeanor with a maximum penalty of three months in jail.

Legalization ‘Inevitable’

In testimony at the hearing, Lancaster County Public Defender Joe Nigro said that the War on Drugs was a failure, just like Prohibition before it.

“Legalization of marijuana across the country is inevitable,” Nigro said. “Use of marijuana runs across racial and socioeconomic lines, yet African-Americans are four times as likely to be arrested and charged for marijuana offenses.”

ACLU of Nebraska Attorney Spike Eickholt told the lawmakers that he’s seen people with less than an ounce of marijuana facing the same penalties as if they’d been caught smuggling 500 pounds of pot down the highway.

“Prosecutors do charge, and in my opinion overcharge, those kinds of cases,” said Eickholt.

The second bill by Wayne, LB652, would make it a Class l misdemeanor to possess a residual or very small amount of a controlled substance, with a punishment of not more than one year in prison, a $1,000 fine, or both.

Wayne said that residue can’t get anyone high, but is still treated as a Class lV felony with a penalty of up to two years in prison and a fine of $10,000.

“Right now there’s no basic distinction and no protection from prosecutors for someone simply caught with a pipe that has residue, versus someone caught with actual measurable amounts (of a drug),” Wayne told the committee.

Nigro said that half of the cases handled by his office were drug cases, 70 percent of which were for possession. Of those, 39 percent were for charges of possessing residue. Changing the law would save the county resources, he said.

“It would be one thing if all of this was reducing drug use and making our communities safer. It isn’t,” said Nigro.

Pennsylvania Town Decriminalizes Marijuana, Sees Future in Legal Pot

Civic leaders in the borough of Steelton, Pennsylvania unanimously passed an ordinance to decriminalize possession of small quantities of marijuana on Tuesday evening. At a special meeting called to considerer the proposal, members of the borough council voted 5-0 to remove criminal penalties for first-time offenders possessing less than 30 grams of cannabis. Simple possession will instead be charged as a summary offense and be subject to a fine of $25 to $100.

Brian Proctor, the president of the borough council, said in a press release that the town was actively pursuing cannabis reform.

“Steelton Borough Council recognizes the changes in attitudes towards marijuana nationally, at the state level, and locally, and strives to be at the forefront of progressive marijuana policy,” said Proctor. “We believe policy needs to change with the times. That includes taking a new look at marijuana, its potential to benefit our community, and realigning criminal justice policy to appropriately fit marijuana-related crimes.”

Borough Manager Doug Brown said that decriminalization is just one aspect of the community’s new approach to pot.

“The passage of this ordinance signals the progressive direction Steelton is taking related to marijuana both in terms of righting a social wrong and preparing the borough for economic opportunity,” Brown said. “Since 2012, other states have shown that marijuana policy can be implemented in a responsible and beneficial manner. Steelton does not have the luxury of being stuck in the past or thumbing its nose at changing times; our survival depends on what is happening now and in the future and that includes being a leader in progressive marijuana policy.”

Brown told High Times that after the vote, the members of the public who attended the meeting clearly demonstrated their approval of the action taken by the council.

“They were applauding when we passed it,” he said. “It was clear that the room was overwhelmingly supportive.”

Town Looks for New Opportunities with Cannabis

Councilwoman Keontay Hodge, the author of the decriminalization ordinance, said that legal cannabis can be an opportunity for business development in the economically depressed community and noted that prohibition is not enforced fairly.

“The burgeoning marijuana industry is critical to rebuilding Steelton’s economy,” Hodge said. “It is foolish and foolhardy to stick our heads in the sand while this opportunity passes us by. It is equally foolish to ignore to [sic] disproportionate impact outdated marijuana laws have on small-time users.”

Brown agreed in a telephone interview that city leaders have a dual interest in cannabis policy reform.

“We all have a socially progressive mind but there’s also the economic development opportunity,” he said.

Brown explained that the community needs to find alternatives to the steel mill that’s been the primary employer for generations in Steelton.

“It’s in our name,” he said. “We were founded on the steel mill. And obviously times have changed, and with the decline of the steel mill came the decline of the town. So we’re in a spot right now where we really have to figure out what our niche is in our area and our region.”

Once employing thousands, the mill is down to about 500 workers today and is subject to recurring rumors of an imminent buyout or closure.

“There’s no clear picture of what the future holds for them,” Brown said. “So we’re in a mode now where we have to diversify. And we have to figure out what the new Steelton is and what the Steelton of the future is, and obviously, we see where the trend is going with cannabis.”

In 2016, Steelton was one of the first communities to pass a medical marijuana zoning ordinance after Pennsylvania legalized the medicinal use of cannabis. The town is now home to a RISE dispensary and has formed a committee to explore its options for the expected state legalization of recreational marijuana. The borough council has also formed a special committee and tasked it with studying the implementation of legal cannabis in other jurisdictions and to follow efforts to legalize recreational marijuana in Pennsylvania.

“What we would like to do is to have an ordinance ready to go for when the state gets to the point that it’s ready to pull the trigger on recreational,” said Brown.

Steelton has already experienced how legal cannabis companies can spur further economic development. After the opening of the medical marijuana dispensary, Coexist Gallery, a glassblowing shop, opened nearby. This July, the company will be hosting residencies for nationally and internationally known artists to create and sell one of a kind pipes and dab rigs, with some proceeds going to fund a community art foundation.

“It’s cool to see the spin-off economy that’s growing from it, as well as the community aspect where we have new stakeholders investing in the borough, all because of our progressive attitude toward marijuana,” Brown told High Times.

Legal Marijuana Toke Prompts Pentagon to Review Security Clearance of Tech Billionaire

Using marijuana is legal in California, but apparently, if you’re up for top-level security clearance with the U.S. government, you may want to think twice. employment attorney

The Orange County Register reports The Pentagon is reviewing the federal security clearance of California tech billionaire Elon Musk following an on-air marijuana toke on a comedian’s podcast last fall. Musk reportedly refiled the SF-86 security form required of federal contractors and/or employees who seek security clearance. The form requires filers to answer truthfully whether they have used any illegal drugs at any point in the previous seven years. Musk reportedly had a higher-level secret clearance, thanks to his position spearheading a company (Space Exploration Technologies Corp. – SpaceX for short) that is permitted launch of military spy satellites.

The company’s day-to-day operations aren’t overseen by Musk, and the company won several national security space launch contracts in the wake of the podcast, but the Register reports it’s only with the refiling that Musk may have some issues.

Employers, Contractors Allowed to Set Ground Rules for Off-the-Clock Cannabis Use

Los Angeles marijuana employment attorneys know that while most people aren’t grappling with billions of dollars or military spy programs and top-level security clearance, many ARE dealing with employers who are leery of cannabis use.

Some key points for employees to know are:

  • Federal law places very few restrictions on employer drug testing of employees or prospective hires.
  • The right to drug test employees/potential hires extends beyond just those in government jobs to those in the private sector too.
  • California courts have held that the employer’s reason for drug testing does need to be balanced with the right of the employee for privacy.
  • State courts have held it is lawful for employers in California to require applicants to pass a drug test as a condition of employment – so long as all applicants for a certain position are tested and there is no singling-out of applicants on an unlawful basis.

Although California law allows individuals to use marijuana for medicine or for recreation, there is no requirement that employers must hire a person who tests positive for marijuana. In fact, the California Supreme Court has held that employers are not required to do so – even if they are prescribed the drug for a disability.

Still, employers may be on less solid legal ground in drug-testing existing employees, absent some reason to suspect drug use.

In most cases, one’s off-the-clock use of the drug in California is increasingly less of an issue, as the stigma of marijuana use subsides. But as Musk found out, even billionaires aren’t necessarily immune from the impact in some cases, particularly considering marijuana use remains a federal crime, despite the fact that nearly three dozen states have taken measures to decriminalize it.

How On-Air Use of Pot Could Impact Musk’s Security Clearance

Musk’s decision to smoke marijuana during a podcast discussion with comedian Joe Rogan highlights the discrepancies between state and federal law pertaining to marijuana, but as many federal attorneys noted, the security clearance challenges should come as no surprise.

Although it’s possible the U.S. Defense Department could simply close the case and update Musk’s record without issue, it should be noted that smoking marijuana is considered a “serious breach of security protocol” and rounds for termination of a federal employee or loss of clearance for a contractor. A department spokesperson said the agency doesn’t comment on individual applications, reapplications and reviews for individual security clearances.

A Los Angeles County sheriff’s deputy scheme to get rich by robbing a marijuana dispensary – and cover it up by making it look like a government raid – did not go according to plan. Now, he’s facing 40 years-to-life in federal prison after pleading guilty to five felonies related to the faux raid. The nearly $650,000 in cash, money orders, half-ton of marijuana and Mercedes-Benz he allegedly heisted during the operation were also turned over to federal authorities. L.A. marijuana criminal defense lawyer

Los Angeles marijuana criminal defense lawyers have taken note that this is one of the most brazen robberies of a dispensary in recent memory. The Los Angeles Daily News reports the law enforcement officer, age 41, pleaded guilty to conspiracy and possession with intent to distribute marijuana and armed robbery. He was also convicted of depriving others of their rights under color of law.

One of his co-defendants pleaded guilty to many of the same charges, as well as being a felon in possession of a firearm. That individual was also convicted in state court of burglary in the second-degree, as well as possessing marijuana for sale and assault with a deadly weapon. He is also facing a lifetime behind bars.

Sentencing is slated for early summer. Four other defendants are also accused, one having signed a plea agreement to testify against the others. 

An Elaborate Plan to Rob a Los Angeles Marijuana Dispensary

Authorities allege the men committed the crime using a vehicle registered to the sheriff’s office and wearing official sheriff’s deputy clothing and posing as legitimate law enforcement agents who were purportedly executing a search warrant on the downtown L.A. warehouse. After detaining three of the warehouse’s security guards inside the marked vehicle, federal prosecutors allege the deputy and his co-conspirators drove into the warehouse parking lot with a rental truck and loaded up all the cash and goods they could find.

The robbery took two hours, during which time the LAPD received a legitimate call for service at the location. When those officers arrived, those involved allegedly tossed their sheriff’s deputy jackets and ran out the back door. The actual deputy remained on site and told the police he was conducting a legitimate search. He showed them his badge, and allowed the officers to speak to an individual he claimed was his sergeant (it was not). But the officers apparently believed him and left the scene, allowing the robbery to continue.

Each of the men expected to receive tens of thousands of dollars for their role in the heist.

Fighting Mandatory Minimums for Felony Marijuana Crimes in L.A.

There’s a lot to unpack about this case, which by no means is your typical Los Angeles drug arrest. But one striking thing our Los Angeles marijuana criminal defense attorneys know most anyone who is charged with a drug crime can relate to is facing down the mandatory minimum penalties.

Per federal law, the most severe penalties are reserved for high-volume trafficking of the eight substances identified per the U.S. Controlled Substances Act to be either Schedule I or II, meaning they  are the most susceptible to abuse and least appropriate for medicinal use without tight controls. Nonsensically, marijuana remains a Schedule I narcotic for this purpose. Owners/operators of dispensaries are in danger of getting roped into these minimum mandatory penalties if they don’t follow the exact letter of state law because of the high quantities they work with.

However, it’s important to point out that these “mandatory” minimums may not be as mandatory as they might seem at first blush. For instance, it is within the discretion of some courts not to prosecute individuals on certain crimes. Sometimes, your attorney can have discussions with the state attorney or U.S. attorney before charges are filed and negotiate a plea that involves lower-level charges, particularly if the offenses were non-violent and you have no prior criminal record. Federal courts can also choose to bypass mandatory minimum sentences for non-violent offenders with an otherwise clean record in something called the safety valve provision.

Courts recognize that drug offenses in particular have led to an explosion within the federal prison population – from roughly 24,000 in 1976 to 184,000 as of early last year. Half of those are incarcerated for drug offenses, and they account for nearly three-fourths of those serving mandatory minimum sentences, according to the Congressional Research Services.

Los Angeles, West Hollywood, Weigh Allowing Pot Smoking in Public

In California, vaping or smoking marijuana in public is not lawful. You’d be forgiven, however, if you didn’t realize that walking on any random strip in Southern California. Lighting up almost everywhere has become practically ubiquitous. Homeowners, renters and businesses have had their share of complaints. Some businesses have even posted explicit signage making it clear: No smoking allowed. Nonetheless, the smell wafts on near every corner. marijuana lawyer

Los Angeles marijuana lawyers know there has been an uptick among local law enforcement citations for smoking in public areas, particularly those nearby to schools, parks, restaurants, shops and in cars or boats. (No, you cannot light up in a car, even if you’re a passenger.) Police say many individuals aren’t familiar with this provision of the law, and even visitors who have come to the state on vacation end up leaving – well, not on probation, but with wallets $100 lighter. That’s the fine for public marijuana smoking in California.

Common areas in apartments and even balconies are forbidden spots for outdoor pot smoking, though that usually goes unchecked unless your neighbors complain. This restriction has become particularly burdensome for those who use the drug as medicine. 

Even recreational users scoff at the law, though. After all, it’s supposed to be regulated the same way as alcohol, and if you can walk into a restaurant or bar and order a drink of alcohol in public, why not allow the same for cannabis?

The City of Los Angeles has issued statements indicating it does not sanction or license consuming marijuana in any public space, though the city’s Department of Cannabis Regulation is working alongside the city’s planning department to establish licensing for public pot consumption lounges. Council is expected to receive those proposals for consideration later this year.

Furthermore, NBC-4 Los Angeles reports a number of advocates have successfully convinced leadership in West Hollywood to to approve plans to open potentially eight new locations for individuals to smoke the drug in public and another eight locations for people to consume edible marijuana products. Some say the permitting process has been moving at a snail’s pace, but at least it’s moving somewhat. Most cities in the state seem keen to keep it under wraps.

California State Restrictions on Public Use

In the meantime, the California Department of Public Health clearly outlines where it is lawful – and unlawful – to consume cannabis in any form. Basically, as our Los Angeles marijuana attorneys can explain, you’re restricted to private residences. That’s if you want to be on the safe side. Technically speaking though, you are expressly prohibited from smoking, using, eating or vaping cannabis in public places or anywhere it is not legal to smoke tobacco. Even private property owners can ban the use of cannabis on their property, which includes not just hotels and resorts but also apartment and condo complex owners.

The law further disallows:

  • Using cannabis within 1,000 feet of a daycare center, youth center or school while children are present.
  • On federal lands like national parks – even if the park is in California. (It’s under federal jurisdiction, and the drug remains illegal under the U.S. Controlled Substances Act.)
If you are in possession of cannabis in your vehicle, it needs to be in an approved sealed package or container or in the trunk. You can be cited for having an open container of cannabis in your vehicle – either while driving OR riding in the passenger seat, the same way you would alcohol.
You also cannot take your cannabis across state lines, even if you’re traveling to a state where cannabis is legal.
Also be aware that per California law, employers have the right to bar the use of marijuana by their employees, so it’s a good idea to know what your employer’s policy is before you imbibe – even off-the-clock.

Florida Man Burns Pile of Pot Leaves in Backyard, Leads Cops to His Stash Inside

Where there’s smoke there’s fire. And where there’s weed smoke, there are nosey neighbors. One towering column of cannabis smoke later, and police arrived at the home of Fellsmere, Florida man David Ellis. To officers’ surprise, Ellis made no effort to hide the open burn that was quickly engulfing the trimmings from a few dozen cannabis plants. In fact, he welcomed officers inside his home, just to make sure they understood the difference between flower and trim. Because in Ellis’ words, he wasn’t burning cannabis, as police claimed. He was burning “trash, the stuff you don’t smoke.”

Florida Man Gives Sheriff’s Deputy the Easiest Weed Bust of His Life

As Indian River County Sheriff’s Deputy Luke Keppel pulled up to Ellis’ home, he quickly saw what prompted a neighbor’s complaint in the first place. Blanketing the quiet neighborhood in a smokey haze, the unmistakable smell of cannabis wafted through the air. At ground zero was an open pile of debris, Deputy Keppel said, spewing out flames about a yard high.

When Keppel knocked on the door of the residence, Ellis answered. Together, the officer and the Florida man walked toward the burning debris pile. Ellis told the officer it was just leaves. It wasn’t a lie. Leaves, stalks and other trimmings from several small cannabis plants were in the fire. Keppel accused Ellis of burning cannabis. Nah, Ellis replied, he was just burning leaves, just burning trash. If Deputy Keppel wanted to see cannabis, he should come inside. And that’s exactly what Ellis invited Keppel to do. “I’ve got a quarter pound of it inside,” Ellis explained.

Deputies Thankful for Gracious Arrestee

Inside, Deputy Keppel saw enough to call for backup. He saw a large aluminum baking tin filled with raw flower. Pipes and bongs littered the kitchen and living room, Keppel wrote in his report. Keppel and Ellis went back outside the house. And Ellis, who had been attending to a howling tea kettle, asked the deputy if he’d seen the tray of cannabis. Keppel said he had. “I’ve got more in the refrigerator,” Ellis told Keppel.

By then, backup had arrived. A search of Ellis’ home turned up 174 grams of flower and a little more than a half-ounce of wax. “Did you find it all?” Ellis asked.

Ellis spent the night and an early breakfast in jail before posting $6,000 bond last Friday. He’ll soon appear in court on multiple drug charges. The 64-year-old Florida man is facing felony marijuana possession charges, possession of a controlled substance without a prescription and misdemeanor drug paraphernalia possession. Marijuana decriminalization efforts are spreading across Florida. But in places where police are actually adopting them on the ground, they only apply to misdemeanor possession. Hopefully, Ellis’ graciousness toward his arresting officers will play to his favor in court.

Ohio Highway Patrol Confiscates 55 Gallons of CBD Oil During Traffic Stop

State troopers confiscated 55 gallons of CBD oil last week after discovering several buckets of the hemp extract during a traffic stop, according to a press release from the Ohio State Highway Patrol. The driver and a passenger of a U-Haul truck that had been pulled over for a “marked lanes violation” on Interstate 70 were arrested and taken into law enforcement custody.

Troopers observed “criminal indicators” during the traffic stop just after noon on February 25 in Muskingum County, about 60 miles east of Colombus, according to police. After an OSHP drug-sniffing dog alerted to the vehicle, a “probable cause” search of the moving van was conducted and troopers discovered eleven plastic buckets containing 7,040 liquid ounces of CBD oil, with an estimated value of $165,000.

Both the driver, Joshua Sellers, 37, of Providence, R.I, and the passenger, Richard Defedele, 37, of North Kingston, R.I., were charged with possession of a schedule 1 substance, a first-degree felony. If the men are convicted, they could face up to 11 years in prison and a fine of up to $20,000.

CBD Tightly Controlled in Ohio

Despite the legalization of hemp and CBD at the federal level with the 2018 Farm Bill, cannabidiol remains a controlled substance in Ohio. In December of last year, state regulators announced that CBD from any source fell under the auspices of the Ohio medical marijuana program that was passed into law by the legislature in 2016. With CBD now considered a form of medical marijuana, the Ohio Board of Pharmacy said that products with cannabidiol would only be allowed to be sold by licensed cannabis dispensaries.

“All marijuana products, including CBD oil, can only be dispensed in a licensed Medical Marijuana Control Program dispensary,” the notice reads. “Those marijuana products will have to comply with the rules and regulations of the program. All products must have a known source, as well as known quantities of active ingredients. Testing procedures will be conducted by testing laboratories licensed by the Ohio Department of Commerce.”

“Until dispensaries are operational,” the board wrote, “no one, including board licensees, may possess or sell CBD oil or other marijuana-related products.”

That announcement came despite the fact that retailers across the state had been selling CBD products for years, leading some shop owners to liquidate or remove their stock of CBD goods and others to openly flout the new rules.

Alison Rinehart, the manager of the High Up Head Shop in Columbus, told local media in December that the CBD products sold at her shop should not be confused with marijuana.

“None of our products are derivative from cannabis in any way, shape or form. They come directly from hemp,” said Rinehart. “They all have certified insured lab reports behind them as well. There’s no THC content in them whatsoever.”

E.R. Beach has sold CBD supplements at his four Hemptations pipe shops in Dayton and Cincinnati for seven years. He told local media that he did not intend to stop selling them because of the ruling from the Board of Pharmacy and issued a challenge to police.

“They [law enforcement] are going to have to charge me, and if they charge me, it’ll be for possession of marijuana, and when they test the product, they’ll find that it’s not a marijuana product,” he said. “They could do that at any time.”
