Cannabis Industry Safety & Health A Growing Priority

Workplace safety is a topic of growing concern among those in the cannabis industry amid numerous reports of hash oil manufacturing site explosions because of unregulated use of butane gas. Last year, the California Insurance Commissioner announced a new marijuana industry workers’ compensation program through Atlas General Insurance Services tailored specifically to the cannabis business. The program accommodates an array of risks involved in numerous aspects of work in the cannabis industry – from growing and extracting to lab work and medicinal manufacturers to food and beverage products makers, packaging, warehousing and distribution, transportation and retail work.

According to the Colorado Department of Public Health & Environment, there are a laundry list of potential risks for employees and contractors in the cannabis market. Workers at risk include:

  • Cultivators
  • Trimmers
  • Extraction technicians
  • Edible producers
  • Budtenders
  • Laboratory technicians
  • Cultivation owner/operator
  • Administrative workers
  • Transportation workers
  • Maintenance workers

New Cannabis Laws May Help Black War on Drugs’ Targets a Leg Up on Legal Pot

California is one of the first states to attempt to make right decades of racist drug policies that tore apart families and and destroyed lives. When the voters approved a ballot measure for recreational marijuana, they also allowed those with previous marijuana convictions to apply to have those records expunged. Very few people actually acted on it. So lawmakers last year passed a different measure that ordered prosecutors to review each prior conviction automatically and decide whether to reduce or dismiss the sentences and records of low-level marijuana offenses. It is no secret that for the entirety of the war on drugs’ decades-long span, minority communities suffered the devastating impact to a hugely disproportionate degree. Los Angeles marijuana attorneys have watched how these communities are still punished with a cyclical merry-go-round of arrest, limited employment options and poverty. Increasingly, as marijuana legalization gains traction across the country, many advocates are taking it a step further, asking for a remedy for the racist application of law and policy. In cases where those calls have been heeded, criminal records for marijuana dealing and possession are being automatically expunged. There is also help for members of minority groups looking to launch their own California cannabis businesses.

Still, even current enforcement policies aren’t totally equal. In Oakland, where voters passed a ballot initiative to order police to make marijuana enforcement the lowest priority – even lower than jaywalking – evidence showed a decade later police were still arresting black men for criminal marijuana offenses at rates exponentially higher than their white counterparts. The city’s own statistics revealed nearly 80 percent of marijuana arrests in Oakland were African Americans. Four percent were white people, even though the population of the city is 30 percent white. Although legalization of marijuana has slashed the overall number of marijuana arrests, people of color are still police targets.

Even where whites dominate the population, our Los Angeles marijuana attorneys know we still find that black people who sell or use marijuana are arrested at higher rates. This is true despite the fact that data overwhelmingly shows there is very little variation in the percentage of whites v. blacks who use the drug. Take Colorado for instance, which about 85 percent white. As reported by USA Today, this was the first state to legalize marijuana. There, the rate of marijuana arrests plummeted by more than 50 percent in just five years – 12,700 to 6,150, per state data. BUT – arrest rates for African Americans was nearly double that of white people.  In Alaska, one-third of marijuana arrests involved black defendants, despite them being just 4 percent of the state’s population.

Los Angeles marijuana defense lawyers point out to people who don’t understand why this is a major issue: Imagine a 15-year-old black teen in Southern California whose father has been locked up in an orange jumpsuit for a decade on minor marijuana charges, only to look across the street and see white men in collared shirts and ties making getting wealthy off the same, out in the open.

That’s the kind of scenario California voters wanted to remedy. It was important to do so expressly because the first states that legalized marijuana recreationally made it difficult for anyone with anything less than a squeaky clean record to enter the market. Now many cities are offering special licensing preference to members of minority communities harmed by the war on drugs.

Other areas are catching on. For example, Maryland decriminalized marijuana in 2014, though police can and do still issue tickets. Of the more than 430 citations issued by police in Baltimore in calendar year 2017 – 95 percent were black. This is despite the fact the black population is 60 percent of the total. More than 40 percent of those citations were issued in primarily black neighborhoods.

Marijuana Manufacturers, Site Owners, May be Subject to New Problem: Exploding Factories

As attorneys representing marijuana companies and workers in Los Angeles, we urge them to carefully analyze every aspect of the business plan – including safety. Now, a safety issue previously believed to be fluke with marijuana manufacturers appears to be a growing cause of greater concern: Cannabis factory explosions and fires. Workers have been hospitalized with severe burns and revealing a major issue in an industry that operates without clear safety standards.marijuana factory explosions liability

Politico reports that in the 33 states where marijuana is legal to purchase for medicinal or recreational use, there have been at least 10 fires or explosions in the last five years. Each of those known incidents occurred at sites where workers were tasked with extracting hash oil for use in edible products. Almost every single one of these incidents led to serious injuries for staff who worked on the production line.

The process for extraction is something that is continuing to evolve, and we don’t know all there is to know about it yet. The fire-safety industry hasn’t offered any guidelines or warnings about best practices. That doesn’t mean marijuana manufacturing operations are off-the-hook when it comes to worker safety.

As noted by the California Department of Industrial Relations, all employers ion the cannabis industry – including those who cultivate, manufacture, distribute, sell or test marijuana and/or its products need to protect employees from any health or safety hazard that may arise related to their work.

As long-time Los Angeles marijuana lawyers, we know that any indoor marijuana farming or manufacturing has the potential for danger. For instance, if you raise the CO2 level, we know the plants will grow faster. The problem is this increases the risk of a fire. Because drawing large amounts of metered gas tends to lure the attention of local authorities, some growers choose instead to use butane or propane gas tanks. This can spell disaster – and serious liability for manufacturers and property owners.

We could see an increasing number of cannabis company insurers costs for repairs, workers’ compensation and even death benefits. In 2017 in Oregon, a deadly explosion at a hash oil manufacturer killed two workers. Investigators reportedly discovered bags full of used butane canisters, the highly flammable gas that is used to make hash oil. The fire killed the hash oil manufacturer and a contractor and destroyed the manufacturer’s home and that of a neighbor.

In New York city, a marijuana manufacturing operation burned down a home and ended in the death of a veteran firefighter on scene to respond. Two men were arrested on felony charges. Criminal charges, such as manufacturing concentrated cannabis, child endangerment and causing fire in a structure, have also been filed in connection with hash oil explosions in Boulder, CO and another in Laytonville, CA.

One product that appears to be at least partially behind the spike in fires is a strong concentrate known as “shatter.” It’s a type of cannabis wax derived from butane hash oil. It’s five times more potent and faster than smoked cannabis that is not refined. Although it’s legal for recreational states and sold in marijuana dispensaries, not all locations that make it are lawful dispensaries.

FDA Ruling Spurs City Crackdowns on CBD Edibles

In what is being characterized as an abrupt change in CBD edible products policy, New York City has begun cracking down on CBD oil following by a late-last-year ruling by the U.S. Food and Drug Administration deeming CBD unsafe for consumption in culinary use. Last summer, the Orange County Health Department began paying visits to coffee shops, bars and cafes, seizing CBD-laced food and warning the company to stop using illegal cannabis or else pay a fine. The Orange County Register reported the new rules were causing a major shift in the trend of widespread use of CBD oil. The rules impacted many L.A. restaurants and bars that were beginning to rely on sales from CBD cocktail and/or supplement. Some businesses reported CBD-laced products account for 30 percent of their business.

Last week, Florida’s new Secretary of Agriculture – who ran partially on increasing access to medical marijuana – recently made a public statement asserting CBD is not legal to sell in Florida. There is, however, a pending bill in the state legislature that proposes a state regulatory framework for cultivation of hemp and quality control for CBD. Mandatory testing and FDA approval would all be part of that, but so far, that measure has not passed.

While hemp, the non-psychoactive cousin of cannabis from which CBD (or cannabidiol) is derived, was all but declared legal by the 2018 Farm Bill, CBD remains something of a legal gray area. Although the FDA has approved use of CBD for conditions like epilepsy and seizures, proponents of CBD say it can help calm anxiety, help individuals relax and help dull chronic pain.

In New York City, one local bakery owner told the Daily News she was surprised when health inspectors entered the shop she owns with her husband and started bagging up the CBD-laced rice crispy squares and cookies – products she’d had on her shelf during previous inspections that never caused more than a second look. In a prepared statement, the state health department indicated that while CBD is legal in New York, it has not formally been approved for use in food or drink by the FDA. Until it is deemed safe for the public as a food additive, the department is instructing restaurants not to sell products that contain the substance. In other words – you can consume a drop of CBD oil on your tongue administered to yourself, but you aren’t allowed to put it on a brownie and eat it.

The oil had come to be a common ingredient on menus – everything from lattes to cocktails. Now, at least five restaurants in the city have been expressly told to stop selling CBD-containing products. The city said it was in the process of informing more restaurant owners of the fact that they can’t include it in edibles. There will be a grace period that will probably end around late summer or early fall.

Most states that offer legal marijuana don’t give any health and safety guidance for the budding industry. Businesses currently selling CBD products in Los Angeles should consult right away with an experienced Los Angeles marijuana attorney.

Expect State, Federal Government Crackdown on Illegal Pot Shops, Dealers

The latest report on the recreational cannabis industry in California reveals aggregate profits of about $345 million – not $1 billion as was anticipated in its first year. A new report by the state’s Cannabis Advisory Committee, revealed in-depth that one of the biggest drags on the market is dilution due to black market sales of the drug – often cheaper and more accessible than legal purchases from a licensed dispensary – creating unfair competition. Gov. Gavin Newsome, a staunch proponent of recreational marijuana legalization who received some $340,000 in campaign contributions from the cannabis industry, said it could take at least five years before the market truly hits its stride. One strategy by the state has been to extend timelines to licensed businesses to comply with all aspects of complicated state and local regulations. However, some evidence suggests this could be hampering business for those already in compliance. Part of the problem also has to do with the fact the state lacks adequate resources to enforce the laws. Pot shops also pay hefty taxes and must invest in significant resources to manage a cash-only operation.

Recently, the governor announced plans to expand the effort to shutter illegal cultivation of marijuana, particularly those operated by international drug cartels in Northern California. Specifically, he’s lending expanded aid from the California National Guard to assist the federal government in cracking down on black market marijuana operations. Analysis by New Frontier Data, a private company that follows marijuana industry trends determined 80 percent of the cannabis sold statewide is black market pot. Profits for illicit marijuana sales are estimated to be four times that of the legal market. 

An estimated 150 troops would be sent to the U.S.-Mexico border to assist the federal Counterdrug Task Force, targeting trade in Northern California. State officials have also vowed to speed up efforts to license more legal marijuana businesses.

A chairman of a cooperative of 130 licensed cannabis growers recently noted to an L.A. Times reporter that enforcement of state laws has been patchy, expensive and largely ineffective.

The state has reportedly issued licenses to more than 630 marijuana retailers. It’s also issued more than 2,840 cease-and-desist notices to businesses believed to be operating in marijuana cultivation and distribution without proper licensing.

Last week, officials reported there had been five significant enforcement actions against scofflaw growers and retailers. These resulted in more than a dozen arrests and civil forfeiture proceedings on hundreds of thousands of dollars’ worth of cash and assets. Los Angeles marijuana business attorneys know that it’s not clear however how many of those businesses closed shop following the state’s cease-and-desist. It’s also not certain that even if they did close, they didn’t simply pickup and go elsewhere.

Substantial state budget cuts in 2011 were cited as reason to eliminate the state’s narcotics bureau, which worked with regional task forces to root out illegal drug operations.

In Los Angeles, the Marijuana Enforcement Unit of the city attorney’s office reportedly filed about 170 misdemeanor marijuana cases in 2018 against more than 700 defendants for operating without a lawful California cannabis business license. There have also been actions taken by the California Department of Justice and the California Highway Patrol.

Meanwhile, the state has been after technology firm Weedmaps, urging them in increasingly stronger terms to wipe its database of marijuana firms that operate with no permit. Weedmaps has countered that it enjoys federal preemptive protections, the same as Yelp or Google. Marijuana legal experts in California know there probably isn’t much more they can do, as Weedmaps isn’t and could not be a licensee of the state cannabis control bureau.

U.S. Bill Would Allow Medical Marijuana for U.S. Military

Medical marijuana has long been known to be effective in treating conditions like anxiety, post-traumatic stress disorder and chronic pain. Yet the U.S. military has long taken a hard-line stance against marijuana, a position solidified during the Vietnam War as reports blasted on the evening news indicated that half of all soldiers deployed were regularly using marijuana. A study by the Pentagon later revealed the actual figure was closer to 70 percent. This, along with the crash of an aircraft carrier by soldiers later found to have marijuana in their systems led to a zero tolerance policy. California medical marijuana veterans

This has led to all sorts of injustices. Historically, it’s been military policy to exclude from entrance any individual who previously used marijuana as a civilian. In recent years, waivers for “past misconduct” have risen, and are expected to continue rising. Just last year, for instance, the Military Times reported a Vietnam War veteran and head of a military school in Florida was terminated for using medical marijuana extract to treat cancer.

Now, Congressional leaders have filed twin bills in the House and Senate to change federal law that would allow U.S. veterans who abide by state medical marijuana laws to avoid federal intervention and would allow doctors with the Department of Veterans Affairs to issue medical marijuana recommendations to their patients. The Veterans Medical Marijuana Safe Harbor Act, sponsored by U.S. Senate Democrats from California and Hawaii, notes that the drug is legal in 33 states and that medical marijuana can be used to treat chronic pain without the use of dangerous and highly addictive opiates. The sponsor of the House version of the bill said in a statement, “it’s past time to end the anti-science, anti-health cannabis prohibition laws that prevent veterans from accessing health care.”

Our Los Angeles medical marijuana lawyers also believe that veterans and their doctors should be allowed to make health care decisions that are informed – without political interference.

This legislation, if passed, would also require the VA to initiate a study of the impact of medical marijuana on veterans suffering from pain, and the relationship between treatment programs involving medical marijuana to treat the chronic pain of veterans in states where it’s legal, how many veterans have access to those programs The proposal would allocate $15 million to support this research.

These measures are virtually identical to the legislation proposed last year in the Senate, but this year, it adds protection for medical marijuana policies of Native American tribes as well as in states where the drug is legal.

Sponsors note that states like California that allow medical marijuana have nearly 25 percent fewer opiod overdoses compared to those states with tight restrictions that do not allow medical marijuana. The provisions in the law that would shield veteran patients and their physicians would sunset after a period of five years, after which it would require renewal.

As longtime Los Angeles medical marijuana attorneys, we know veterans have increasingly been turning to marijuana as medicine to treat some of the conditions most common among combat soldiers.

Republican-controlled House and Senate majorities in recent years have blocked legislation that would lift or at least loosen federal restrictions on marijuana, considered a Schedule I narcotic under the Controlled Substances Act. Increasing evidence indicates overwhelming support for medical marijuana at all ends of the political spectrum.

California Cannabis Bureau Cracks Down on Unlicensed Pot Shops

If you are operating a marijuana business in Los Angeles County without a license: You’re probably going to want to promptly seek legal representation from lawyers with longtime experience in state and federal marijuana criminal and civil cases. The California Bureau of Cannabis Control reported it had carried out search warrants on two businesses – one in Los Angeles County and the other in Sacramento County – for allegedly operating an unlicensed cannabis company.Los Angeles marijuana lawyer

January 9th marked the end of what state regulators called the grace period for unlicensed marijuana businesses across the state. This was akin to a warning shot, with the agency noting the several hundred unlicensed marijuana retailers and delivery services statewide are “taking their chances.” Even if they do close shop, there is no guarantee authorities wouldn’t take action after the fact, though it’s more probable they’ll want to pursue action against those in active operation.

Licensed L.A. marijuana retailers have been complaining for the last year that black market operators were undercutting their sales with an unfair advantage. The Sacramento raid stemmed from a complaint filed with the BCC, though the agency didn’t indicate where the tip originated. 

Many of the shops slated to be targeted were formerly collectives and co-ops allowed to operate through last year despite not having a license. They had protection from state prosecution as designated medical collectives, but that expired officially last month. Unfortunately, while many of these collectives were long-standing, there aren’t that many licenses to go around. Some smaller marijuana businesses may be priced out of licensing in some areas.

Los Angeles marijuana licensing attorneys know it’s been an especially problematic issue in this area because the city has been snail-pace slow to issue licenses. That means despite some of these operations are among those that have been operating legally in the state for two decades. Now, those business owners must decide whether to completely close up shop because the city hasn’t expedited their registrations, or do they take “take their chances” and continue to operate on the black market. Some owners told MjBizDaily.com it wasn’t just themselves they were concerned about; long-time medical marijuana patients would be losing their access too.

Whether we’re going to see a slew of raids is unclear. It will likely depend on the volume of complaints in any given region and the available resources to address it.

Although arrests were made by California state authorities, as future arrests promise also to be, there’s no guarantee operations selling marijuana outside the statutory structure of the state framework won’t risk federal charges, especially if there is any indication the business crossed state borders. The Obama administration’s Cole Memo, which the Trump administration has indicated – at least for now – it will abide, vows Department of Justice expenditures for prosecuting federal marijuana trafficking crimes only extends to those businesses that are following state law.

The business in Sacramento was an unlicensed cannabis delivery service, while the business in in Los Angeles was a retailer. According to regulators’ press release, authorities with bureau’s Division of Investigation seized $250,000 in cannabis and related products from the search in Sacramento County and another nearly $28,000 and two firearms from the unlicensed marijuana store in L.A., where six people were also arrested.

California Cannabis Asset Protection When Commerce is All Cash

When medical marijuana dispensaries and collectives first started cropping up around California in 1997, they had to heavily guard their assets – both product and cash. Banks, cowed by federal law that might ensnare them on criminal money-laundering charges, denied accounts to almost everyone who profited from cannabis, a Schedule I narcotic. More than 20 years later, although California was late to join the recreational sales party, our Los Angles cannabis lawyers have seen so much of the legal landscape change. Profits are not only allowed, but encouraged. Collectives and co-ops were outlawed as of last month. Businesses are licensed and heavily regulated and taxed. Everything from seed-to-sale is tracked and tested by outside labs.

And yet: Most Southern California marijuana businesses still can’t convince banks to do business. That means in a world where e-commerce is booming, retail stores are shuttering and most people pay with plastic, marijuana businesses can’t move money electronically. So every time cash must be moved – to pay a vendor or file taxes – it’s almost always coordinated with teams of gun-strapped security officers (many ex-military) and armored cars, equipped with bullet-proof glass and high-end GPS tracking.

Los Angeles marijuana business asset protection lawyers know that beyond just being inconvenient and unnecessarily expensive and inefficient – physically moving cash is still very dangerous. It’s an issue many of our clients in Southern California frequently lament. They want to bank like every other business, and wish the federal law that still subjects their firms to outdated accounting methods would catch up to the 21st century.

Collectively, California marijuana companies carried out some $5 billion last year in transactions. All of it was in physical cash – except at five locations, all credit unions, the only ones willing to take the risk. (Credit unions have a bit more flexibility as non-profits.) All California credit unions servicing cannabis companies are at capacity – mile-long wait lists or flat-out not accepting new clients. As The Daily Democrat learned, none of them are keen to even acknowledge those accounts publicly.

It’s not just the extra security they need both inside and outside the building or anytime they move product or cash. It’s not the heavy steel bars and alarms and cameras that cover the property. It’s counting money once, twice – four times, just to be sure there hasn’t been an error that will result in significant losses. It means no official electronic confirmation receipt from an FDIC-backed institution. It means losses on interest their money might otherwise collect were it stowed in a bank, rather than stashed in a vault.

The entire expanse of the supply chain and extending through taxes – all of it, cash-only. No credit or debit cards. Internal ATMS are located inside for customer convenience. Growers, producers, suppliers, distributors, laboratories, state governments, ancillary businesses, employees – almost all always paid in cash.

The good news is nationally, some 375 banks and more than 100 credit unions DO accept deposits from marijuana-related companies, which is nearly triple the number who took on the risk five years ago, per the U.S. Department of Treasury’s Financial Crimes Enforcement Network. Most will only work with cannabis businesses that are physically located in the same community. They still risk money laundering charges – a big concern in the early days of the Trump presidency when U.S. Attorney General Jeff Sessions announced revocation of the “Cole Memo.” The internal policy directive put an end to the constant spate of state-legal cannabis businesses in California by announcing a halt on expending U.S. Department of Justice funds to state-compliant operations. As of this moment, it doesn’t appear to be a top priority for the administration.

As NBC Los Angeles recently reported, now that regulations in the year-old recreational marijuana industry are beginning to settle, some companies are revamping their whole image in an effort to appeal to a wider audience. (Years of “reefer madness” propaganda, a spotty patchwork of state medical marijuana statutes and a spate of federal raids hadn’t helped the industry’s image.)

Building on this previously-untapped market, long-time dispensaries are taking a new tact on branding, while those just breaking into the market are working on forging their recognition for the first time. Unfortunately, because federal law – specifically the U.S. Controlled Substances Act – remains at odds with the now-majority of states that legalize the drug in some form, not all types of intellectual property protection are available to marijuana businesses. Nonetheless, acting on available protections now can help combat copycats in the present while better positioning them to seize further opportunity if/when the government does repeal the CSA.

What Exactly is My Marijuana Business Brand and Why Does it Matter?

All businesses need some degree of differentiation to effectively promote, get people to know who you are, recognize you and cultivate loyalty. A “brand” is everything about you – from your name, your theme, slogan, the type of products/services you offer – down to the colors and font you choose. But as an L.A. marijuana intellectual property rights attorney can explain – not all of that is protected due to the unique legal status of marijuana businesses.

By protecting your brand, you are protecting what makes you distinct from other businesses. The whole idea of intellectual property law is to promote innovation and creativity by awarding those who generate it – while depriving the copycats of those same rights. Innovation and creativity are investments. Intellectual property protections give you a way to make sure no on else profits form your ideas.

What Intellectual Property Protections Are Available for California Cannabis Companies?

Trademarks are symbols, designs, phrases or words that identify you and set you apart from the competition. Typically, you’d protect this by registering your trademarks with the U.S. Patent Office. Unfortunately, trademark protection is usually not available because of a clause in the U.S. Trademark Act that requires registrants to show they aren’t using their trademark in illegal transactions. Marijuana is illegal under federal law.

What you can usually still file for is copyright protection, which doesn’t have this same requirement. You can theoretically argue commonlaw copyright without every needing to register for anything so long as the work is wholly original, somewhat creative and tangible/can be reproduced. Your marijuana intellectual property lawyer may advise you though to register whatever copyrighted material you can to be safe.

However, while copyright laws may protect a logo (image), they probably won’t extend to your brand name, tagline, slogan, etc. That falls under the purview of a trademark. You can submit all of this for copyright protection and not receive a flat-out rejection (copyrights aren’t vetted the way trademarks are), but you may not be able to enforce anything in the copyright but the images.

It’s important that whoever your cannabis business attorney is has experience in intellectual property law and understands how best to ensure your own work is protected from infringement – and also that you have solid legal standing if you’re accused of infringement by another company.

California Ranks in Top 5 for Marijuana Business Entrepreneurs

Marijuana business entrepreneurs are increasingly striking green in the Golden State. If you’re looking to launch a new pot shop or any company ancillary to the cannabis industry: California is a prime location. Our Los Angeles marijuana business attorneys could have told you that, but this comes from a new report by FitSmallBusiness.com, which ranked California the No. 5 best state in the U.S. for cannabis start-ups. marijuana entrepreneur

The study analyzed numerous factors, including how easy it is for a new business owner to enter the market, what it costs to do so, how much you’ll pay in taxes, how many laws and regulations exist and the overall market opportunity.

Oregon wrestled the No. 1 spot, Colorado No. 2, Michigan No. 3 and Alaska No. 4.

The fact that we aren’t first – despite being the biggest legal marijuana market despite being the largest marijuana market – was attributed largely to our patchwork of laws and hefty taxes (15 percent excise and a sales tax for recreational product). There’s also a mid-range startup fee – $5,000 for business applications. Compare that to Oregon where the fee is a cheap $250 but then also to Illinois, where a cultivator licensing fee costs $200,000 – all but ensuring any prospective small business owners would be pushed out.

Still, California secured the most recreational marijuana revenue of any in 2018 – it’s very first year – at $2.75 billion. Yes, it’s true California has more people – but that’s to the advantage of a burgeoning bud-minded business. We have 39 million people – but that’s a lot of markets to tap.

Employees and contractors of California cannabis companies are are commanding a decent wage – nearly $59,000 median annual salary last year – though that does encompass a large range of professionals. There are those physically handling the product, such as farmers and trimmers. There are state-approved lab technicians in charge of mandated quality testing. And companies can’t overlook the necessity of Los Angeles marijuana business lawyers, accountants and even marketing experts. Cannabis companies cannot operate the same way as every other in the state. There are a host of local and state regulations, walking the fine line of federal law (which also has an impact on banking, real estate and taxes). That has meant most marijuana business start-ups in California are dealing mostly with cash, which means you’ll need to be meticulous with keeping records – including vetting customers.

Within California, Los Angeles was the No. 2 metro area in the nation for cannabis-related jobs (12 percent of the total nationally), compared to San Francisco, with 13 percent. Denver with 7 percent was third. Los Angeles cannabis business workers make an average of nearly 11 percent higher than the going national rate, which is a median of little less than $53,000.

Recently, one Los Angeles-based marijuana firm, MedMen, had its stocks listed on the Canadian Securities Exchange. While our northern neighbor legalized marijuana last year, the U.S. federal government has not – a complication that continues to hamper all marijuana entrepreneurs nationally. However, while a spokesman for the large L.A. marijuana venture noted the New York Stock Exchange is hesitant to invest anything until the market is fully legal, he noted that the industry as a whole is growing by 25 to 30 percent a year. Global sales for legal marijuana are expected to double in the next two years to $22 billion.

Growth won’t sustain that pace forever, though, which is why there is a green rush to get in on the ground now – and do their homework by meeting early on with an attorney to formulate a feasible business plan.

The Legality of Listing Illegal Los Angeles Marijuana Shops: Weedmaps Cites Tech Company Protections

Recreational marijuana use has been legal in California now for little more than a year, but access to the drug remains scarce in some regions. That’s why some – including those who seek non-psychoactive CBD oil – are relying on a technology app called Weedmaps to help them locate the nearest provider. Our Los Angeles marijuana attorneys are aware this has generated a few problems stemming from the fact that a number of the providers listed on the platform aren’t legally allowed to operate by the state and have not been subjected to the same rigorous quality assurance regulations as legal marijuana businesses.marijuana lawyer

From a patient’s perspective, that means the product they are receiving may not be 100 percent safe or accurately-labeled with proper potency levels. From the perspective of marijuana businesses, these other companies have carved an unfair advantage over them because they operate in regions they do not and/or have not had to pay the mountains of fees for taxes, licensing, workers’ compensation and quality assurance testing. From the state’s perspective, these businesses are flouting the regulatory framework of the law.

As reported by Wired.com, marijuana businesses can list their services on the site for free, but top billing requires an advertising fee. Some companies pay as much as $20,000-a-month for top-level billing on the site, which doesn’t vet firms to see which are technically legal and does not indicate those pot shops that pop up first on the site have paid for that placement.
