California Employers Ease Zero Tolerance on Cannabis

California employers long have long availed themselves of their right – as affirmed by the state’s high court – to carry out zero tolerance policies against workers who use drugs – even if that drug use takes place off-the-job. That means many companies require new applicants to pass a drug screen before they start and employees (so long as it’s totally random or the company has some reason to suspect drugs are being used on-the-job). This was true even here in California, where medical marijuana has been legal since 1996 and even with the passage of Prop. 64 that legalized recreational use.California cannabis drug testing

We could see this changing, especially because part because the California Supreme Court’s ruling in Ross v.  Ragingwire Telecommunications (one of the most recent to address this issue) was predicated at least partially on the fact that the U.S. Supreme Court had affirmed challenges to the federal law in part because deemed marijuana dangerous Schedule I drug. Recently, the U.S. Attorney General said he’d favor a new bill protecting cannabis businesses and users from federal prosecution as long as they were in compliance with federal law. This measure has broad bipartisan support, as does another that would shield banks doing business with these companies from federal money laundering charges.

It’s not clear either measure would necessitate de-scheduling the drug, but doing so likely impact legal precedent in numerous areas of law – including employment and its zero tolerance. for drugs.

The History of Employer Zero Tolerance Policies

The policy gained its first real foothold in 1986, when then-President Ronald Reagan signed an executive order requiring all federal employees to refrain from any use of illegal drugs as a condition of employment. That included by on duty and off.

Two years after that, federal lawmakers passed the Drug-Free Workplace America Act, which allowed mandatory drug-testing of employees AND government contractors, citing safety concerns. This was with the exception of the postal service certain units of the legislative and judicial branches.

Those measures only applied to federal employees, but local and state decision-makers adopted similar programs under state laws and implemented zero-tolerance programs for drug-free workplaces.

As Los Angeles cannabis employment law attorneys know, there is nothing in the U.S. Constitution that bans this, and in subsequent case law, various limitations were imposed to ensure the government wasn’t acting in a manner that was discriminatory or in violation of a person’s constitutional rights to be protected against unlawful searches.

California Employers’ Shifting Stance on Worker Pot Use

Since the advent of legalized marijuana, positive drug tests rates of climbed. They rose 10 percent last year, to reach about 2.3 percent. Rates were higher in states where marijuana is legal.

Meanwhile, the state’s unemployment rate has grown to 4 percent, meaning companies have to stay competitive if they want the best worker. Establishing a provision that we recognize at this point to be arbitrary could exclude a wide range of qualified workers.  It would be akin to testing new applicants on whether they consumed alcohol the previous week (which we can’t, because alcohol is processed through the body at a faster pace.

When billionaire CEOs are smoking marijuana on air for a laugh, it garners a bit less credence to the opposing side.

What Supreme Court’s Wayfair v. North Dakota Means for CA Pot Shops

Tomorrow is the federal tax filing deadline, and a recent ruling by the U.S. Supreme Court has California’s small cannabis businesses concerned about being hit with a tax bill from jurisdictions in which they may have never set foot. Los Angeles cannabis lawyer blog

Los Angeles marijuana tax lawyers can explain this is a case about the astronomical uptick in e-commerce sales and the right of states to pursue taxes from businesses that conduct online transactions with merchants or buyers in those states, but that have no actual physical presence there.

In a 5-4 decision, the US. Supreme Court in South Dakota v. Wayfair Inc. overturned previous precedent requiring physical presence from an out-of-state seller for a state to establish jurisdiction for purposes of pursing an entity for sales and use taxes. In previous case law, physical presence of an out-of-state seller might include things like inventory storage, office maintenance, meeting attendance or delivery of owned/rented vehicles located in the state. No more.

Plaintiff South Dakota enacted its own law that established grounds to pursue taxes from out-of-state sellers that had an “economic nexis” with either more than 200 separate transactions for goods and delivery sold or with revenue that exceeded $100,000 in a given year. Under the law, the state billed three online retailers – Wayfair, Overstock and Newegg.

All three fought back. While they easily met the minimum requirements for taxation under the state’s law, the corporations argued the state had no grounds on which to pursue this, particularly given prior U.S. Supreme Court precedent.

The high court sided with the state, overturning prior rulings on the physical presence standard, finding it to be “unsound.” Further, justices opined the new ruling is more closely reflective of our modern economy, in which e-commerce has quickly come to dominate major retail markets for everything from toothpaste to couches. The court said the ruling evens the competitive playing field between local businesses that pay state taxes and those that swoop in from elsewhere and bypass them.

What Impact Does Wayfair Ruling Have on California Cannabis Industry?

No mention was made by either party or any justices in this case on how this might impact sales of adult-use marijuana in California. However, as our Los Angeles marijuana business attorneys can explain, almost all legal cannabis sales in the Golden State occur intrastate. That means cannabis businesses aren’t selling across state lines, which would run afoul of state (not to mention federal) marijuana trafficking laws.

Although this may become a greater issue as federal rules appear on the verge of easing and interstate cannabis sales seem closer to reality, for now, your local dispensary probably won’t be affected.

However, there is the potential of the unintended consequence that local jurisdictions might take this precedent and run with it. That’s more problematic for cannabis companies because, as you likely know, the array of local cannabis rules run the gamut.

Last year, a San Francisco ordinance imposing additional gross receipts tax (also known as a business license tax) starting at the beginning of January 2021 – and expanded it to include companies with adult-use marijuana sales in the city of more than $500,000 in gross sales.

The Wayfair ruling COULD have a direct impact on the California hemp industry and CBD industry, where products are sold across state lines, as allowable by the 2018 Farm Bill.

U.S. Attorney General: Federal Marijuana Prohibition “Intolerable”

Federal law on marijuana prohibition has created an intolerable legal mess. (Tell us something we don’t know.) What’s notable is this sentiment was expressed by the U.S. Attorney General William Barr, who indicated he preferred the system laid out in a bipartisan House bill that would reform the law, allowing – finally – greater harmony between state and federal marijuana laws.Los Angeles cannabis lawyer

Barr’s remarks have cannabis business attorneys and others abuzz about whether this could be the true turning point that allows us to finally align federal and state marijuana laws. (It’s also worth noting they are in stark contrast to those of former U.S. Attorney Jeffrey Sessions, who was staunchly opposed to legal cannabis in any form or federal cooperation to facilitate it.

Speaking to the Senate Appropriations Committee, Barr said his preference is a legislative fix to the clash in statutes, one that ideally offers express rights to states to decide their own marijuana laws. At this point, all 33 states with legal medicinal marijuana and 10 with recreational marijuana in violation of federal statutes – namely the U.S. Controlled Substances Act. The classification of cannabis under that provision simply defies logic, but it’s not less a possible risk. Los Angeles cannabis dispensaries, delivery drivers, cultivators, manufacturers and labs ALL should have a cannabis attorney on retainer to help ensure compliance with state laws and minimize the risk of federal ire on issues ranging from taxes to trade.

Both the Department of Justice and the U.S. Treasury Department are actively reviewing a bipartisan bill with swelling support that would formally shield those in compliance with state marijuana statutes from the risk of federal prosecution. This has proved a major issue in the raids common early in the Obama Administration’s tenure, prior to The Cole Memo. Although the Trump administration has thusfar respected the memo (one of the few Obama legacies Trump has left alone), there is not guarantee this or the next administration wouldn’t flip the switch – absent a federal law.

Interestingly, even lawmakers personally in favor of a single uniform federal law against marijuana legalization are starting to concede the situation isn’t sustainable. One example is Sen. Lisa Murkowski (R-Ala). She said if there cannot be consensus that allows federal prohibition, she’d concede to a compromise. However, she wants an approach that favors federal sovereignty on the issue. So rather than leaving states to their own devices on this and forbidding meddling by federal authorities, she floated the idea of a federal law that would create a single uniform framework from which states could work within. That way, the federal government retains jurisdiction.

It’s not clear whether that would mean states like California would have to completely rewrite their cannabis laws. Marijuana lawyers in Los Angeles will be watching this development closely.

The results of the reviews by the DOJ and the Treasury could be influential in whether the current measure (the Strengthening the Tenth Amendment Through Entrusting States Act, STATES Act for short). Both agency leaders said this bill (and another that would expressly protect financial institutions serving marijuana businesses) is being analyzed by top brass before a consensus is announced.

This doesn’t exactly amount to a formal approval stamp from Barr, he did say the DOJ would not stand in the way to block passage of a bill like the STATES Act as written, which may be an encouraging foreshadowing of broad bipartisan support.

U.S. Bill Would Protect Pot-Using Veterans’ Military Benefits

Marijuana has proven an effective treatment for many military veterans grappling with conditions like chronic pain, PTSD (post-traumatic stress disorder) and symptoms of exposure to toxic chemicals like Agent Orange. A new bill filed by a U.S. House of Republican – with bipartisan support – would protect veterans from losing their federal benefits for using medicinal marijuana. Additionally, the Veterans Cannabis Use for Safe Healing Act would allow doctors at the Department of Veterans Affairs to recommend cannabis for medicinal purposes to patients there.

L.A. Attorneys Fight for Military Veterans’ Cannabis Rights

Los Angeles cannabis attorneys for years have fought to prevent veterans from losing these critical benefits simply for seeking medically necessary treatment. A measure like this would solidify a military veteran’s entitlement to services  – and further enshrine them so they could not be altered subject to the whim of future federal administrations. Taking it a step further (and to avoid any conflicting messages on this) the proposed law would also change the existing VA rules that prevent doctors within the department from filling out any forms that might help a veteran obtain medicinal marijuana.

As it stands now, VA doctors are restricted to discussing marijuana with patients and noting in medical records when/if they reveal medicinal use.

The bill’s sponsor released a statement underscoring his commitment to making sure military veterans get the care they deserve and aren’t unfairly penalized for seeking or obtaining it.

Bipartisan Support for Military Veterans’ Marijuana Rights

The fact that both Republicans and Democrats are coming together on this issue, particularly now at a time of bitter partisan infighting on almost everything, speaks volumes about the fact that the tide is well into the midst of turning when it comes to federal law and marijuana.

The drug continues to remain a Schedule I narcotic under the Controlled Substances Act, placing it in the same category with heroin, methamphetamine and LSD. These are drugs that have no recognized value as medicine, are incredibly addictive and dangerous. Obviously, this descriptor is nowhere near inaccurate, and it isn’t reflective of sweeping state law changes the last two decades (starting with California).

Although cannabis operations are tenuously protected from federal prosecution thanks to The Cole Memo, there are indicators we may see tangible changes on the horizon. The 2018 Farm Bill declassified hemp and CBD-derived hemp. Months earlier, the U.S. Drug Enforcement Administration bumped CBD from a Schedule I classification to the much lower Schedule V.

Santa Cruz Sues State to Protect Local Pot Shops, City Oversight

Santa Cruz is a community that is known for its laid-back lifestyle – the redwoods, the shoreline and red wine vineyards. Just don’t mess with their pot shops. Los Angeles marijuana attorneys have learned the city is suing the state in an effort to fend of out-of-towners from nearby San Francisco and Oakland from cannabis from swiping customers from their home-grown cannabis companies.Los Angeles marijuana delivery driver

The city’s chair of the board of supervisors argues that local businesses are being undercut by these services because the playing field isn’t level, and further the city has no say in regulating the interlopers.

Santa Cruz Says State Backing Out on Its End of the Bargain

Recently, the state altered its regulations to permit state-licensed marijuana delivery companies to sell their product wherever consumers are. Santa Cruz isn’t the only city taking issue with this – 25 in all are suing the state, asserting this new stance is a work-around the provision of Proposition 64 (which legalized marijuana for recreational sales and use) that assured local governments would have authority to put a stop to brick-and-mortar sales.

On the other hand, part of the big-picture goal with Proposition 64 was to make the drug legal and widely available, which in turn would not only generate state tax revenue, but also cut the legs off black market operators. That hasn’t exactly happened, however, because so many local governments have banned sales, cannabis customers have few options BUT to turn to the black market, where supply is ample (the state produces 9 million pounds of the plant, but currently only has a legal market demand of 2 million pounds). Allowing statewide delivery is one means of combating this problem AND allowing greater access to a legal product for adults in those “dry” communities that want it.

Currently, this is the only state (of the 10 that have passed laws allowing recreational cannabis sales) that allow home delivery in every jurisdiction, regardless of the stance by local authorities. Santa Cruz is a bit different than some of the other plaintiffs suing California over its marijuana delivery rule in that it DOES allow local sales of recreational pot at brick-and-mortar shops.

Community leaders say they embraced Prop. 64 in large part due to the local controls it afforded. The city was one of those embracing regulation early on, running a tight ship and becoming one of the first to strictly regulate every aspect of legal marijuana sales from 24-7 surveillance cameras to heavy taxation to precise requirements for building permits.

Even as other communities in the Bay area dragged their heels for months adopting marijuana local cannabis regulations (which pot shops had to obtain just to open their doors), Santa Cruz was all-in. Officials identified businesses ready to play by the rules and even hosted a “Weed Day” on 4/20 where locals gathered for a ribbon cutting of a brand new dispensary.

Now, as the San Jose Mercury News put it, the onslaught of bud deliveries (there are 311 currently licensed by the state) are “harshing its mellow,” with cannabis home deliveries as easy as ordering takeout. Customers are responding. When given the option to drive to a dispensary and wait in line or have it brought directly to the for a fee, twice as many will choose the latter. Meanwhile, city governments like Santa Cruz reap no amount of the reward from that deal – even though one delivery service even named its business after the city’s area code.

Cities Suing State Adopt “Just Say No” Slogan

The cities that are banding together on this have (rather unfortunately, in the view of our Los Angeles marijuana lawyers) adopted the old Reagan-era slogan: Just Say No. The phrase is problematic in conjuring up the widespread damage of the failed “War on Drugs,” which lead to long-term prison sentences for non-violent drug offenders, crowding prisons, breaking up families and damaging whole communities. (California is one state in particular that has tried to right this wrong to the greatest extent possible, expunging criminal records dating back decades. The process is supposed to be completed by next year, removing impediments convicts faced to assistance with housing, education loans and employment. Los Angeles alone has an estimated 50,000 cannabis convictions to purge.)

Despite the fact that cannabis legalized in California, interstate sales are almost sure to land you in handcuffs. Federal law prohibits any form of cultivation or retail sales. Officials with the U.S. Department of Justice have largely agreed to look the other way since The Cole Memo, so long as the cannabis commerce in question strictly adheres to state law. The memo says nothing about interstate sales and distribution, which some states expressly prohibit. State senators are crafting a bill that would permit cannabis exports to other states in the U.S. as of 2021.

Oregon’s Legal Cannabis Market Strain Fuels Push for Trade Beyond State Borders

There are a few different issues at play, primary among those being the glut of supply that has fueled the black market.  Last year, state lawmakers fought hard to enact SB 1042, which would have given the green light to cannabis and ancillary businesses vetted by the state to the right to export cannabis grown in Oregon. Of course, absent a change in federal law, any companies exporting the drug would face serious repercussions under existing provisions of U.S. law, namely drug trafficking. As marijuana is still considered a Schedule I narcotic, and trafficking across state lines could have serious implications for your assets and your freedom.

But Los Angeles cannabis lawyers know many marijuana advocates consider it a matter of time before the federal government Oks legal sales. Oregon cannabis businesses want to be on the forefront.

In terms of public opinion with the power to say federal authorities, few could argue Oregon has the right idea. Nearly 65 percent of Americans are supportive of recreational marijuana legalization, according to Gallup. Beyond that and similar to California, the marijuana supply cultivated in Oregon is far in excess of local demand. As it stands, the state reportedly has an oversupply of approximately 1.4 million pounds of the plant, causing wholesale pot prices to plummet (flower rates dropped from $3.90 per gram in Q1 2018 and fell to $1.86 by Q3), jeopardizing the financial stability of scores of Oregon’s licensed marijuana businesses. This appears to be what’s largely driving swelling intestate sales support from state lawmakers and opinion-based media.

Why Intestate Cannabis Trade is a Huge Legal Risk

The giant roadblock, of course, is Section 801 of the U.S. Controlled Substances Act, which still – despite recreational legalization in 10 states and medicinal legalization in 33 states – classifies the drug as Schedule I, among the most addictive, dangerous and with no therapeutic purpose. Federal  law expressly prohibits sales of marijuana between states and to markets overseas. Additional federal guidance from the 2013 Cole Memo also states marijuana can’t be sold between states – even when both have legalized the drug.

What all that means is if Oregon – or California or any other state – decided approve cannabis trade across states, they’d be risking a federal crackdown. Some fear it would further compromise the tenuous agreement outlined in the Cole Memo that encourages federal prosecutors to essentially look the other way when it comes to state-legal marijuana operations. (The Cole Memo is not law, and could be revoked at any time.)

On the flip side, proponents say passing a bill like this would put Oregon could be placing itself a step ahead of the game by passing this measure now if the federal government does shift its position on legal marijuana. 50k Los Angeles Marijuana Convictions to be Dismissed, Reduced

As many as 50,000 Los Angeles marijuana-related convictions are to be dismissed or reduced, the L.A. District Attorney said, noting completion will not only align with California’s 2020 deadline for prosecutorial review of expungement for pot crimes – it will beat it by nearly 9 months. This same group was reportedly also involved in helping San Francisco expunge more than 9,000 marijuana convictions earlier this year – even though some of those date back to 1975. The Los Angeles D.A. has said she expects the same to be the case here, pointing out that Department of Justice records in cannabis cases go back more than seven decades.

Los Angeles marijuana expungement attorneys know the chances of someone with a 1940s cannabis conviction is both alive and has any real interest in having their name cleared, is unlikely. The D.A.’s office has said they aren’t necessarily starting with the oldest cases first, and will instead be prioritizing those individuals who are looking for:

  • Housing
  • Employment
  • A fresh start

It’s also worth noting that not all prior convictions are going to be expunged. Those who most likely would not receive an expungement would include:

  • Registered sex offenders (regardless of whether the cannabis offense was related);
  • Those convicted of violent offenses;
  • Individuals convicted of large-scale drug trafficking or habitual drug offenses

Although she did not break down the details of the priority list, she did indicate her office would most likely be starting with cannabis cases involving low-level, first-time non-violent offenders.

This doesn’t mean anyone whose prior offenses see to fit the bill of the former category should assume they have no shot at prosecutorial review, and neither does it mean those in the latter category should automatically presume they’re home-free. People who have a pressing and vested interest in having their Los Angeles cannabis conviction expunged, dismissed or reduced should promptly contact an L.A. marijuana criminal law firm skilled in defense and expungement. It’s possible with the benefit of a qualified marijuana attorney, it may be possible to request for a case to be expedited.

The D.A.’s office said that while it lacked the resources to pursue wiping clean all these convictions with its own resources, the algorithm supplied by the third-party non-profit allowed it to quickly identify which cases would be eligible to have cases would have been eligible for the benefit. Although an expedited process is always welcome, it’s not impossible that a case may have been deemed “ineligible” by mistake. That’s why it’s a good idea to have your old California marijuana conviction reviewed for expungement eligibility.

The way prosecutor’s were going about it initially would have-all-but-required a lawyer. Individuals interested in having old cannabis cases expunged – and doing it right – needed an attorney to help review the forms, prepare them, file them, file them in the correct court and then pay to obtain the record.

The system of automatic expungement in Los Angeles means basically that the state handles the entire process for you – and you need never go to the trouble. Again, this is great – but only if the system works as intended and there are no glitches.

Even if your criminal record has been expunged of cannabis convictions, you may not even know it. Although the agency is working on the best way of getting word to people that their records are clean, they’re also trying to be cautious of privacy and avoid inadvertently revealing the expunged information to a third party.

The non-profit agency points out there are 1/3 people in the U.S. with a criminal conviction and in California alone (one of the more relaxed states on this front) those people face 4,800 legal obstacles – in housing, employment, education, parenting time and more. 25 Cities Sue California to Block Unfettered Marijuana Delivery

More than two dozen cities that restrict legal cannabis sales are suing California over the issue of legal pot delivery. Los Angeles marijuana delivery business attorneys are paying close attention to this litigation, wherein plaintiff cities argue that by allowing home deliveries in cities where it is restricted, the state is breaking key provisions of Prop. 64, the legislation that opened the door to legalized recreational marijuana in California.Los Angeles marijuana delivery attorney blog

The California Bureau of Cannabis Control and its chief are named defendants in the case, which was filed in the Fresno County Superior Court. The dispute over marijuana deliveries comes shortly after the regulation adopted by state bureau earlier this year, holding that businesses licensed by the state have permission to deliver marijuana – even in municipalities that have expressly banned the operation of marijuana retail locations.

Cities Make the Case for Local Authority to Restrict Cannabis Deliveries

Among the most significant concerns cited about a free-for-all on cannabis home delivery:

  • Public safety risks, particularly robbery, given the cash-only model of legal marijuana sales;
  • An influx of illicit marijuana delivery/sales that may be difficult for law enforcement to identify/shut down.

City officials point to the specific provision of Prop. 64 that was woven into the statute with the purpose of appeasing police chiefs and city leaders: That which offers significant local control of California marijuana sales. Plaintiff asserts local control was baked into the ballot proposition with the express intent of allowing local governments to regulate activities related to marijuana sales, and that the state lacks authority to insist on allowing cannabis deliveries against local ordinances because state law guarantees local veto power within those respective jurisdictions.

Approximately 80 percent of the state’s 482 cities have barred cannabis retailers from either setting up shop or selling the drug for recreational purposes.

However, not all plaintiff cities have prohibited recreational sales. Instead, they want assurance that the only marijuana delivery services allowed to operate in their district will be those that are not only state-approved, but locally-screened and licensed. For example, Beverly Hills prohibits marijuana retailers, but restricts deliveries to medical cannabis patients with a valid prescription.

In Riverside, city leaders say it should be local leaders with authority to regulate if deliveries can be made and by whom in order to protect residents’ quality of life.

Plaintiffs in the case aren’t collectively opposed to allowing deliveries to continue in cities where the practice is sanctioned, but the state’s updated policy on marijuana delivery goes back on the promise that Prop. 64 made to cities that went neutral on the issue.

CA Cannabis Allies Insist Home Marijuana Delivery Safer, Aligned With Voter Intent

Ongoing state efforts to expand retail sales are in jeopardy if the cities are victorious, and Los Angeles marijuana delivery lawyers know this could have big implications for dispensaries throughout the state. The retail marijuana market in California last year was estimated to be worth approximately $1 billion.

A spokesman for the California Cannabis Industry Association stated the cities’ success in this effort would strip consumers throughout the state of their right to a legal product and would force retail locations far and wide to fold. For many consumers, delivery is the only realistic way they can access the product – particularly in areas that prohibit storefront sales.

Proponents of statewide legal deliveries point out that if cities are going to deprive people in their communities of the only realistically lawful way to purchase cannabis, those communities are going to lose two-fold:

  • Consumers will be driven to the black market, which has a far higher crime risk than legal sales by delivery;
  • Local and state taxpayers miss out on potential revenue.

State regulators insist that allowing a means for safe, legal home delivery by vetted companies, they are following the intent of the law, and assert that while cities do have the authority to govern commercial marijuana sales in their jurisdiction, they cannot impose their authority to limit general consumer access.

Los Angeles marijuana home delivery attorneys recognize the significant of this lawsuit goes beyond this issue and represents the first time Prop. 64 has faced a real legal challenge in California. It’s certainly not the first showdown over interpretation of the law or who has jurisdiction over what, but this one has the potential to make it to the California Supreme Court.
