California Marijuana Investor Accused of Plot to Kidnap, Murder Cannabis Business Partner

Los Angeles marijuana attorneys know the cannabis industry has worked diligently since Proposition 64 was passed to shed its past image of lawlessness. An alleged plot in San Diego isn’t helping, though the case has helped bring to light certain marijuana businsess regulatory loopholes that state lawmakers are now working to address. Los Angeles marijuana lawyers

Local news media is reporting a prominent property owner and marijuana owner, along with two associates, is accused of cooking up a plan to kidnap and murder a business partner while in Mexico. He has been arrested on charges of criminal conspiracy, leaving the Southern California cannabis community stunned. Many trade industry groups have refused to discuss this case, and while our Los Angeles marijuana attorneys will point out that the accused is innocent until proven guilty, it is important to point out that even if proven, this conduct is not reflective on the rest of the cannabis business community – despite the way in which staunch prohibitionists in many communities will undoubtedly attempt to twist it.

The truth of the matter is concerns regarding public safety that were raised time and again by die-hard cannabis prohibitionists haven’t been realized. The truth of the matter is in San Diego, where these individuals reportedly worked, has not reported any noticeable uptick in violence among operators of the city’s lawful marijuana dispensaries. Of those violent incidents that have been reported, almost all involved illegal, unregulated cannabis dispensaries. Legalization and regulation is a form of protection not only for owners and operators of the business itself, as well as neighbors, customers and connected industries. 

Dark Turn in Bud-Related Business Dispute 

The case out of San Diego reportedly stemmed from civil litigation over control of a number of marijuana businesses in the city. Ownership of the dispensary had been sharply disputed for well over 12 months, leading to a number of civil lawsuits and counter-lawsuits.

Defendant reportedly had put up some $44 million for the cooperative and its related businesses, which included operations for growing, manufacturing and distributing the drug. However, his name was excluded from both the state and local applications because, as he later stated, he wanted to sidestep any increased scrutiny he might incur from authorities.

Los Angeles marijuana lawyers know this was the specific case that exposed a loophole wherein certain types of marijuana industry venture capitalists are able to fly under the radar, prompting state regulators to take action in the form of rules proposed by the state’s Bureau of Cannabis Control. The new proposed rule requires all licensed marijuana businesses to divulge more information about both companies and individuals who have any sort of ownership stacks, essentially barring silent partnerships and making state officials aware of who stands to profit.

Still, the litigation in this matter pressed on, with rhetoric becoming increasingly escalated. Alleged victim filed a restraining order three months ago, accusing defendant of hiring thugs to intimidate him and steal his mail. The restaurant he managed was spray-painted and he stated he feared for his life.

According to the criminal complaint filed in the U.S. District Court Southern District of California, defendant and two others met a few times over the last couple months with a person they did not realize was an FBI informant. The alleged plan was to lure the business partner across the border into Mexico, where he’d “disappear for good.” The trio reportedly paid a $1,000 cash deposit to the informant.

Some worry this case could hamper efforts to expand the California cannabis industry. Yet the as-yet-unproven allegations seemingly provide additional evidence that legalization and regulation are the way to move this industry out of the shadows.

Los Angeles Marijuana Lawyer: Shipping Cannabis From California is Risky

Although cannabis has been legal in California for recreational use since the start of this year, Los Angeles marijuana lawyers know there continues to be much confusion as to what is allowable and what isn’t in the course of conducting business. One legal woe cropping up of late involves marijuana shipping and transport. Shipping out-of-state (or sometimes even in-state) is fraught with legal pitfalls. If you are not careful, you and/ or your associates could wind up facing serious criminal charges, not to mention hefty fines.Los Angeles marijuana business lawyer

Because the federal government considers marijuana to be a dangerous narcotic, it is a federal felony offense to transport it interstate. Because of the Supremacy Clause in the U.S. Constitution, the federal government can prosecute you for federal crimes, even if your actions are legal under state law. In-state transfers can be done lawfully, but it depends on the circumstances.

California’s Bureau of Cannabis Control lays the groundwork for the state’s digital track-and-trace system and is responsible for licensing every vehicle used to transport marijuana across the state.

Cannabis Delivery by Road Transport

Generally speaking, individuals over 21 transporting less than 1 ounce for non-commercial purposes in-state shouldn’t have an issue with law enforcement. However, businesses are going to be held to more stringent standards. Los Angeles cannabis industry lawyers know this marks a substantial change for many businesses, which for many years following the 1996 Compassionate Use Act were sort of operating in the wild west when it came to marijuana transportation because there weren’t any regulations at all. In many ways, the new rules make it safer because the expectations are clearer and legitimacy of one’s actions under state law can go a long way. On the other hand, fail to abide those stringent rules, and once again, we’re facing serious consequences.

As of right now, state rules require vehicles used to transport marijuana be owned or leased by someone with a permit issued by the state bureau. Anyone who transports cannabis or cannabis products are required to scan their seed-to-smoke RFID tag upon both pickup and delivery. Vehicles must be equipped with GPS technology and are required to stick to a predetermined route with no unplanned stops. Vehicles used for this transport must be smaller than 10,000 pounds because anything over that is regulated by the federal government. That’s why you see most marijuana deliveries are conducted via armored cars or Sprinter vans.

Shipping Marijuana by Mail

Marijuana by mail might seem quick and easy, but your Los Angeles marijuana industry lawyer can explain it’s a quick-and-easy way to get locked up. This is true no matter where that mail is headed. The reason is that all mail delivery service in the U.S. is overseen by federal law – including not just the U.S. Postal Service (USPS), but also UPS and FedEx.  Per 18 U.S. code 1716, using the USPS to mail marijuana – even within the territorial limits of California or to another state where the drug is legal – is a felony offense. It is true that because USPS is a federal agency, a warrant is necessary in order to initiate a search for drugs, and packages are protected under the 4th Amendment to the U.S. Constitution. However, if there is reason to suspect a package is suspicious, workers can obtain a warrant and if you’re convicted of using USPS to mail marijuana, it can result in up to one year in federal prison plus a fine of up to $250,000 – possibly more, depending on the quantity.

Even use of third-party carriers isn’t safe for shipping cannabis either. First of all, because they aren’t federal or government agencies, they aren’t under any obligation to get a search warrant before searching a package they deem suspicious. The U.S. Supreme Court in fact ruled that use of a third-party carriers for shipment removes any reasonable expectation one might have had for privacy and gives a lot of discretion to the carrier. Those companies might not want to lose customers, but they also don’t want to end up in hot water themselves either. This is exactly what happened when FedEx was indicted in 2014 and UPS in 2013 for transporting illegal painkillers and other prescription drugs through unlawful online pharmacies. UPS actually paid $40 million to settle the case. Although neither involved marijuana, it still established a huge incentive for these companies to make sure they are monitoring their packages for illicit substances.

If you are found to be the original deliverer or recipient of such a package, you could be charged either under state or federal law. Consider that per federal law, mailing as little as 50 grams of bud can result in a maximum five-year prison sentence.

So our Los Angeles marijuana industry lawyers would conclude by saying: Yes, you technically can mail your marijuana. People do it every day. However, they are rolling the dice with the law. New California Cannabis Shop Hopefuls Face Barriers to Entry

This year was the first in which Californians could freely grow, sell, buy and use marijuana purely for purposes of recreation without the constant threat of criminal law enforcement intervention. Prop. 64, which opened the doors to recreational marijuana, imparted a significant amount of power and discretion to local jurisdictions to decide the type and volume of marijuana businesses that would be allowable. Some communities, like San Jose and San Francisco, embraced commercial cannabis at the outset. Meanwhile, others like Fontana have tried to outlaw the shops entirely. Those with the harshest restrictions have in some cases (Fontana, for instance) been successfully challenged.

For the most part, communities agree the drug should be legal, but just practically speaking, it takes time to supplant an unregulated market. Questions have still arisen regarding how the wealth should be distributed, who gets a chance to participate and how tight should restrictions be. It’s had a ripple effect in places like Los Angeles, which has approved just three of the hundreds of annual licensing applications received by the Manufactured Cannabis Safety Branch. Ancillary companies can only work with those that are licensed, so they’be been stuck at a standstill too.

State and local agencies insist they are doing all they can to keep the licensing process moving. More California Marijuana Dispensaries May Be Cropping Up in Sacramento

Amid the booming Southern California cannabis industry, the City of Sacramento is weighing whether to lift the existing cap on the number of marijuana dispensaries licensed to operate in the city, the primary goal being to offer more opportunities to minorities. Since 2014, the number of pot dispensaries permitted by the city has been capped at 30. When recreational marijuana was legalized in California almost a year ago, the city maintained that cap, allowing only those dispensaries that already existed authorization to continue selling. No new licenses were distributed. Of those dispensary owners, not a single one is black. This is problematic and has been vocally opposed by the California Urban Partnership. Still, it is considered an issue worth addressing, particularly considering people of color are more likely to have been victimized by the failed War on Drugs and have prior drug-related convictions. The city did form a program, CORE, that will waive permit fees for new dispensaries, but because of the cap, no new dispensaries can even be opened once the program officially launches.

Talk of raising the number of dispensaries allowed in the city arose for this reason, though the mayor conversely suggested preference could be given to minorities should one of the existing dispensaries happen to close. However, that’s fairly unlikely, given how lucrative California marijuana dispensaries are and will almost certainly continue to be. 

Even if the council did decide to raise the number of marijuana dispensaries allowed, it will probably be at least another 1.5 years or more before any additional actually opened. As Los Angeles marijuana dispensary attorneys know, these types of decisions rarely come swiftly are effected in short order. Even the typical bureaucratic difficulties with which we grapple are compounded when it comes to cannabis because of its ongoing status as a Schedule I narcotic per the U.S. Controlled Substances Act. Furthermore, despite legalization of recreational marijuana by the state, heavy taxation and stringent regulations have spawned a thriving black market.

In Sacramento, one of the ongoing issues with the legal market is concern that existing shops aren’t evenly distributed across the city. Of the 30 brick-and-mortar pot shops in Sacramento, 17 of them are centered in certain fringes, with the remaining few in the city center. That has meant certain districts are over-served and several are underserved. Normally, capitalism would serve as an equalizer, but the problem is, city rules set in place by the council in 2010 barred marijuana dispensaries to be located near schools, churches and tobacco shops.

Since the state decriminalized sales for recreation, the city has loosened its rules a bit, but it’s not been a enough to effect a major shift just yet.

Fontana Marijuana Lawyers Hail Axed Home-Grown Pot Rules

When California voters approved Proposition 64, it included a provision that give wide discretion to individual communities regarding how much of a berth they wanted to give cannabis companies and customers. In San Bernardino County, Fontana marijuana lawyers soon understood that in this community, authorities were eager to take a hard line stance – particularly on home grow operations. Fontana marijuana lawyer blog

Now, Fontana’s de facto ban on home cannabis grow operations has been nixed in a San Bernardino Superior Court ruling, finding the city’s rule’s to be “excessive,” paving the way for individuals to grow and possess amounts of the drug that are more in line with state provisions, which are far more lax.

This is likely to prompt other municipalities to look carefully at their own policies if they are tighter than provisions of state law. 

Fontana Marijuana Lawyers Outline Stringent City Ordinance

The city ordinance in Fontana was strict, effectively amounting to a de facto ban on individuals growing even small amounts of the drug in their homes for personal use.

The ordinance mandated that all residents who wanted to grow marijuana in the city had to first register with the city. It also required they undergo a criminal background check (blocking any who owed fees to the city), open their home to city officials to undergo an inspection and then on top of that pay a substantial fee to do so. Furthermore, it excluded a number of individuals, such as those with prior convictions, from obtaining a permit. Furthermore, the ordinance made it illegal to grow six plants at home absent a permit – effectively making illegal the very thing that Prop. 64 had allowed to be legal.

Court Strikes Down Most of Fontana’s Marijuana Rules

Plaintiff in this case was a man who had been a medical marijuana patient for years, and all he wanted was to grow marijuana for his own use inside his home. Fontana’s marijuana ordinance, he argued, was far too restrictive to be “reasonable” as is required under Prop. 64, the state law.

Trial court judge agreed, echoing the sentiments of the Drug Policy Alliance, which was that the city’s ordinance was essentially designed to deter residents from engaging in conduct that is legal per state law. Furthermore, it effectively prejudiced less wealthy occupants of the city, who would have a difficult time paying the hefty costs necessary to comply with the city’s inspection rules.

It’s a legal victory that could well impact cannabis consumers across California, where many communities have sought to impose restrictions that are altogether unfair and effectively criminalized even those who sought to grow small amounts of the drug for their own personal use. Fontana marijuana lawyers know this was a closely-watched case because it was one of the first legal tests regarding the boundaries of how far cities could go when regulating resident’s rights to use and grow recreational marijuana since the state first passed the law in 2016.

Other communities with restrictive marijuana policies include San Bernardino, Colton, Rancho Palos Verdes, La Canada Flintridge and others.

Prop. 64 is quite clear in its directive allowing those over 21 to grow up to six plants per household, so long as those plants are secure and not visible from the street. Cities cannot restrict that right – something now this court ruling further affirms.

Los Angeles Marijuana Lawyers: Why Illegal Pot Shops are Proliferating

For as long as the people of California have sought marijuana, the black market has existed. Even when the state legalized medicinal use in 1996 and then paved the way for lawful recreational use with a ballot measure last year, Los Angeles marijuana lawyers know the reality is illicit pot shops and sales have always outpaced the legal market. The hope was we’d see a shift, a significant tapering off of demand for illegal marijuana now that with recreational pot now available. But as of right now, they have retained a larger hold than facilities operating according to the stringent regulatory guidelines set forth by state and local officials.Los Angeles marijuana lawyers

Los Angeles marijuana lawyers had seen many long-time operators on the California cannabis scene try to work their way into the newly-forged legal market to finally be legitimate, only to end up continuing to work the riskier – bit more lucrative – illicit market. This includes unlawful medical marijuana collectives, cannabis delivery services and cultivation farms that haven’t been properly vetted according to stringent state law.

Some of these individuals are focused on pursuing “OT” money, generated from “out-of-towners.” Of course, such sales are especially risky because, as our Los Angeles marijuana lawyers know, rules can vary from city to city and certainly from state-to-state and country-to country. Black market sales are playing with fire given the uncertainty of how federal authorities are going to handle future sales. Despite the Jan. 1st legalization of recreational use and sales in the Golden State, cannabis is considered an illegal crop from the top-down under the Controlled Substances Act, and as a Schedule I narcotic, it’s one of the most most heavily regulated – despite being one of the most commonly-cultivated and sold. And it’s going to be extremely difficult to move away from that given its history with illicit sales and use. 

Earlier this year, Gov. Jerry Grown put forth a measure that would set aside an additional $14 million from the state budget to police illegal sales of marijuana in California. The idea was to give the state attorney general five teams that would focus on large-scale illegal marijuana operations with big financial and tax fraud schemes. However, it was ultimately tossed early in the summer when neither side could agree how they were going to pay for it.

Los Angeles marijuana lawyers have seen that six months since the city rolled out its own rules and became the largest legal marijuana market in the U.S., we’re still beset with unlawful marijuana sales and businesses. In fact, most agree it is the majority of the market.

Los Angeles Marijuana Lawyers Anticipated This Issue

This was not an unexpected problem. The primary reason for this issue is any would-be cannabis business in this community is beset by a host of daunting financial demands. These involve not just taxation, but the regulation for things like security and building code upgrades, product quality testing and, yes, attorneys’ fees to ensure compliance. (Though, we’d argue attorney’s fees are much more reasonable and cost efficient than coping with a criminal case.) They must pay for things like workers’ compensation and pesticide control. There are also additional regulations that must be sifted through that can vary from county-to-county, city-to-city.

On top of that, there is a 15 percent excise tax plus a sales tax and certain local fees. Some say this encourages customers to look elsewhere for cheaper marijuana options (and Los Angeles marijuana businesses may go where margins are wider).

There was an effort in Sacramento that sought to lower the bar and make it easier for these unlawful operations to “get legal” by lowering the excise tax there to 11 percent, but it ultimately was put aside for the time being.

Our attorneys have read about some L.A. dispensaries trying to sidestep the issue of hefty taxation by operating an above-board store front on one end and selling black market stock for 40 percent less out of the back to help bolster their incomes. That is taking a huge risk, and those companies need to discuss their concerns with a dedicated marijuana attorney.

For some, it’s not even so much about the money as it is the disgust for cannabis corporatization, which rubs many of the industry founders the wrong way. As Los Angeles marijuana attorneys who have been invested and advising the L.A. cannabis industry since it was first forged, we certainly understand this. But what you do not want to do is toss caution to the wind and risk forever forfeiting your shot of operating fully above-board.

Cathedral City Just Opened SoCal’s First Legal Consumption Lounge

The issue with legalization in California—and many other adult-use states—is that there aren’t many places to legally consume cannabis in public. Many argue this contributes to making “legalization” a scam: how is weed legal if you can only consume it in your home without consequence? One Southern California desert community is providing a solution to that problem. Cathedral City Lounge, located in the Coachella Valley, made history opening the region’s first licensed on-site consumption bar on Wednesday, October 31.

“This is a whole new feeling for people to be able to consume in public without anyone making comments or having to worry about getting arrested,” Nick Hughes, the owner of Cathedral City Lounge, told High Times in an interview. “Comfort is everything.”

Hughes is also the owner of Cathedral City Care Collective, a dispensary the consumption lounge is connected to. He explains the lounge fills a void by providing a place for people to hang out, try new products, and have a safe place to sober-up after imbibing in various forms of greenery.

Cathedral City Lounge is equipped with a pool table, couches, private rooms, music, and a number of entertainment options. Customers can rent pipes, bongs, dab rigs, and other smoking devises. Hughes describes Cathedral City Lounge as a bar with stricter rules. The rules, he notes, are not implemented to hinder the experience. Rather, they’re in place to ensure the safety of customers and staff.

The city granted on-site consumption licenses to a few other businesses in the area. But the city wasn’t totally sure how to organize around onsite consumption lounges, in terms of restrictions and understanding the potential consequences. Thus, Hughes and his team crafted an outline of what they felt were the important things to look for: how to tell if someone’s had too much THC, when to call someone a Lyft, and how to determine if someone needs medical attention. Working with the city in this capacity put Hughes and his team at the forefront of the city’s expectations, allowing Cathedral City Lounge to ultimately open first.

“We created a plan of what we will have available for people if they take too much,” he says. “We’ll have water to keep people hydrated and cookies and snacks in case they get shaky or look green in the gills. We also look for people who are starting to get drowsy.”

Hughes points out that sometimes too much cannabis can cause people to have heart palpitations, which can lead to heavy anxiety, which can eventually put someone in the hospital. Because of this, the lounge has systems in place that track what everyone’s purchased (and how much).

All of the staff is CPR trained, Hughes explains, so if anyone is in danger, the lounge’s staff can step in and help until emergency professionals arrive at the scene. The lounge also has corporate Lyft and Uber accounts in case customers need a ride home but can’t drive.

Another reason Cathedral City Lounge opened before other, similar businesses is because the dispensary was originally built to accommodate a consumption lounge. Thus, no retrofitting was required.

The lounge is open seven days a week from 8 a.m. to 10 p.m. It’s available for parties and private events, and will also function as a place of education for people to learn everything from how to make cannabutter, to proper dosing, to dabbing 101.

“We want this to be a place where the community can gather,” Hughes says. “It’s a venue that can hold bachelorette, bachelor and birthday parties. People can expect educational events, too, and movie nights with medicated popcorn. This is the future, and we’re excited to be at the forefront of it”

As California marijuana lawyers can explain, the biggest problem has been the continued federal prohibition on the drug. Under the Controlled Substances Act defining cannabis as highly addictive and dangerous with no recognized medicinal purpose, those who possess, distribute and transport the drug have committed crimes – even if it was all perfectly legal under state law. This conflict has impacted everything from banking to commercial leasing to business partnerships.

Airline travel is just one more area in which the industry and its consumers need to be mindful. When in doubt, be exceedingly cautious. Check out the policies of airlines both at your departing location and destination city. 

Los Angeles International, which is the No. 5 busiest airport in the world, recently announced a policy change pertaining to pot in the airport. Customers over 21 and older can have their marijuana on site. Similar policies are in place at Sea-Tac and Portland International, both of which abide by state laws in Washington and Oregon. That said, most airlines still won’t allow it on-board, but Portland International even allows travelers to carry their stash on the plane on flights within the state, despite the fact airlines prohibit it.

Indeed, it’s an increasingly tangled legal web, with airports and airlines alike scrambling to keep pace with rapidly-changing laws and public attitudes and consumer demands – while still balancing their obligation to federal law.

Keep in mind, no matter which airport you’re in, personal possession of marijuana won’t be allowed beyond the security checkpoint because this is a federal zone where U.S. law applies. That means no amount of marijuana is allowable. Most airlines won’t let you bring it either.

Still, the Transportation Security Administration (TSA) can confiscate your drugs. That’s not their purpose, mind you – they’re there to combat terrorism, not carry on the failed War on Drugs. So when they do find drugs, they call local police. If you’re in a state and city that allows legal marijuana, usually the most hassle you’ll get is an officer asking you either to throw it away, store it in a vehicle in the parking lot or call a friend to come pick it up.

Police in Portland, Oregon have responded to roughly 80 calls pertaining to airline travelers so far in 2018, compared to 74 this time last year. TSA calls to police at the Los Angeles airport have been increasing also, according to authorities, since the law changed allowing recreational use. Most of these calls, police explained, are due to misunderstanding. They go to a California marijuana dispensary, purchase legal marijuana, pack it into their checked luggage for a flight to Texas, and soon they’re facing felony charges.

In instances wherein TSA doesn’t find your packages of pot, you might actually get through screening and make it onto a flight. That doesn’t mean you did nothing technically illegal, just that you got away with it.

Throughout the airport in Las Vegas, you’ll find 20 so-called “amnesty boxes” where you can toss away your leftover marijuana that you forgot to leave behind before you arrived for your flight. Whatever is left in those containers is destroyed, according to the county government.

Airport authorities in Las Vegas say marijuana isn’t a major issue for them. In fact, it’s the people who are drinking alcohol that tend to be more aggressive and pose a bigger problem. Those who are high on marijuana, they say, tend to be low-key and often apologetic. In Denver, officials say they have more problem with water bottles than marijuana.

The TSA has been known to remove those working in the marijuana industry or those caught traveling with it from the PreCheck or U.S. Trusted Traveler programs (which reduce one’s return into the country).

And while some customers raved to The Guardian about its convenience, others referred to it as a “mini-Fort Knox,” commenting on the security features that made it difficult or impossible for anyone to hack. First-time users had to swipe their state-issued medical marijuana cards and driver’s licenses and submit to a biometrics measure (fingerprint, retinal scan, etc.) and then they could continue their cash-based purchase. A repeat customer needed only to present their card and driver’s license to make their purchase. Machine use was only available during dispensary hours, with the dispensary owner indicating there would never be a vending purchase made from a machine by a customer whose ID wasn’t first checked by a human.

Now in California, a pot vending machine has cropped up in Santa Cruz. Cannabis consumers can browse the bud options at the dispensary “bar,” but the vending machine inside offers grab-and-go choices. The machine has an array of flowers, vaporizers, edibles and chocolates from which people can choose. The interface requires an ID – with a built-in security feature to verify your age – and cash. Identifications are also checked at the door before customers enter. The company says it “triple verifies” customers to ensure they are of age.
