Marijuana Business Lawsuits Allege Federal Racketeering

Although a federal judge last month dismissed a racketeering lawsuit last month against numerous marijuana businesses, the plaintiff still has grounds to refile on the basis of a private nuisance claim. This matter in Oregon is noteworthy for our Southern California marijuana business lawyers because it’s one of several that take aim at cannabis industries and companies that are sanctioned by the state using a federal law that was passed for the purpose of tanking organized crime (drug cartels in particular).marijuana business attorney L.A.

The Racketeer Influenced and Corruption Organizations Act, commonly referred to as “RICO,” is a U.S. federal law providing criminal penalties as well as a civil cause of action for acts performed as part of an ongoing criminal organization. It was formed to target the mob.

According to one recent report, these lawsuits are part of a wider strategy nationally to “upend legal weed.” In Oregon, some law firms actually focus exclusively on suing marijuana businesses for racketeering under the RICO statute, 18 U.S.C. Chapter 96. As reported by Willamette Week, a single attorney represented a woman who has sued more than 200 businesses, all that had ever been involved with her neighbor, a single marijuana processing plant that squeezes the THC oil from the flower for use in cannabis-infused candies. That lawsuit alleged that every dispensary and grower that had ever done business with the neighbor conspired to commit crimes that damaged the value of plaintiff’s home. That crime was growing a product deemed illegal by federal law, specifically the Controlled Substances Act.

Aside from the immediate expense to the companies involved, the greater danger with marijuana RICO lawsuits is that if successful, they would be a potentially huge and expensive risk for cannabis companies next to annoyed neighbors. In Oregon particularly, many marijuana businesses are under immense financial strain because of the bargain basement wholesale prices thanks to an over-saturated market.

Plaintiff says that when neighbors grow marijuana next door, it slashes their own home prices because the smell wafting from the farm next door is powerful, “skunk-like” and unmistakable.”

The same attorney representing her has reportedly filed a number of complaints for others in rural Oregon targeting legal marijuana operations. One of those was settled out-of-court.

Attacking state-sanctioned marijuana businesses in courts using RICO is a novel use of the statute, but our L.A. marijuana attorneys recognize it is one that appears to be catching on in other areas of the country as well. Some law firms are actually offering education courses to potential plaintiffs for some $200 each to teach them how to sue marijuana companies using the RICO statute. More than a half a dozen of those cases have been filed in federal courts across the country. As of yet, none of these cases have gone to trial. However, a number of legal strategists think the tactic could work, and that’s something about which our California marijuana lawyers feel we need to warn clients. Marijuana Business Breakup Heads to Court

As the marijuana industry becomes more mainstream, our L.A. cannabis business lawyers are seeing many of these companies facing down similar legal challenges as other traditional companies. These include employment lawsuits, business partnership disputes, injury and premises liability litigation and more. However, many of these cases are even more complicated by the fact that the industry is so highly regulated at the state and local level, and of course the fact that their primary product is technically illegal under the federal Controlled Substances Act. business attorneys

Recently in Oregon, a marijuana business owner filed a lawsuit to ask his nephew and former business partner to halt harassment after the business relationship went downhill in the wake of major crop losses. According to Oregon Live, he is seeking $700,000 in damages. In a separate lawsuit filed by attorneys for the marijuana business itself, plaintiff alleges the nephew and one-time co-owner, of defamation and trademark infringement. The company alleges defendant’s inability to produce a marketable flower with any degree of consistency cost the company several million dollars, and is seeking $2.6 million in compensation.

Plaintiff alleges that the flowers grown under defendant partner’s care were total losses in terms of a shelf-worthy flower, and that this was the result of breach of contract on his part. The company owns and operates a production facility on more than 80 acres in Central Oregon, as well as a retail store in a downtown area. The company seeks to grow with retail locations in three other cities, including Portland, where it has applied for a license. 

Breach of Contract in Marijuana Business

To craft a marijuana business contract that is going to hold up in court, you need to be working with an experienced marijuana business lawyer. If you aren’t careful, your cannabis contract won’t be worth the paper on which it is written – so long as federal marijuana prohibition remains the law of the land.

In many cases, these contracts must:

  • Acknowledge the federal legal status of the drug. Although pointing out the illegality of the substance might seem odd, when you expressly acknowledge that your business includes the process of growing, processing, testing or selling marijuana in contrast to federal law, it gives you a point at which to refute any illegality offense the other side might make.
  • Waiver of illegality defense. This goes along the same lines as the other in making it clear no one anticipates being able to make such an argument in the future should a dispute arise.
  • Selection of forum. This is important because unlike other businesses and markets, the cannabis is industry is one that is very closed-borders. It must operate strictly intrastate in order to avoid federal scrutiny (to whatever extent that is possible). While the people and businesses with whom you’re dealing hands-on are likely to be located in your home state, our L.A. marijuana lawyers are quick to point out to our clients that a lot of the ancillary businesses with whom you are working may not. These include a number of suppliers of materials used in grow, production and retail. Stipulating the legal forum in which disputes must be resolved can help you avoid getting something dragged into federal court later (where the issue of illegality becomes a bigger one).

Budding Minority-Owned California Cannabis Businesses Get a Boost

A new California law signed by Gov. Jerry Brown eases the way for those impacted hardest by the failed “War on Drugs” to launch a budding marijuana business. Senate Bill 1294 aims to counteract the disproportionate impact of the misguided drug ware on minority communities, allowing local jurisdictions in California to apply for a grant from the state’s Bureau of Cannabis Control to aid entrepreneurs who are also minorities in a number of ways, including providing financial support via waiver of license fees, providing technical assistance and more (with $10 million allocated to provide this support). cannabis business

The new law, supporters said, will directly go to helping those who have been more profoundly impacted by the criminalization of marijuana.

The California Cannabis Equity Act was sponsored by the Drug Policy Alliance, noting that cities that have local marijuana equity programs (Los Angeles, Oakland, San Francisco and Sacramento) will have access to the grant funds. Some opponents of this law argued prior to passage that giving marijuana growers a license and access to grants despite a prior marijuana conviction, something even some proponents of legal marijuana argue harms legitimate businesses because some would-be cannabis business owners got their prior convictions growing marijuana unlawfully on land that wasn’t designated for it, thereby harming the environment.

But supporters, like Sen. Steven Bradford (the man who wrote it) paints this as the first “social equity cannabis law” in the U.S. Funding from the grants may also go toward business loans, capital improvements and regulatory compliance assistance. Some of these things may fall under the umbrella of legal assistance, which our L.A. marijuana business lawyers do provide to burgeoning cannabis companies.

The executive director of the L.A. Department of Cannabis Regulation voiced his support, saying the new law will allow for more equitable ownership and employment opportunities within the California cannabis business community.

How War on Drugs Impacted Minority Communities

According to the Drug Policy Alliance, the U.S. claims less than 5 percent of the world’s population, and yet holds 25 percent of all incarcerated people on earth, with an incarceration rate that is 666 inmates per 100,000. Russia, the country with the second-highest incarceration rate, is 430 inmates per 100,000 people. In a single recent year, there were 1.5 million drug arrests in this country and more than 80 percent of those were just for possession.

At every single phase of the judicial system, people of color are more likely to be:

  • Stopped
  • Searched
  • Arrested
  • Convicted
  • Harshly sentenced
  • Handed a lifelong criminal record

Prosecutors are twice as likely to impose mandatory minimum sentences for black offenders compared to white offenders for the exact same offense. We have substantial evidence now this was by design. An interview recently published by Harper’s Magazine, based on a 22-year-old interview of one Richard Nixon top adviser, indicated that in 1968, Nixon’s campaign targeted, “the antiwar left and black people.” They enacted policies expressly to alter public opinion and suppress those communities. Some of those policies still haunt to this day.

One in every 13 black person of voting age in the U.S. is denied the right to vote due to a prior felony conviction. Nearly 3 million children are growing up in U.S. homes where one are more parent is incarcerated and more than two-thirds of those are for non-violent offenses (including a substantial number of drug possession violations).

So the question is: Should cannabis business owner hopefuls of color be further prejudiced by that prior conviction and lack of capital? SB1294 seeks to remedy that.

A marijuana business expo is now in its fifth year in L.A., with NBC-4 defining it as an event for cannabis growers, entrepreneurs, investors, doctors and users to gather, network and collaborate. As California is poised to become one of the biggest marijuana markets on earth, thanks to its recent legalization of adult recreational use of the drug. The expo is held until the end of the month, with booths making available a variety of businesses, services and products. But as the market grows, our L.A. marijuana business attorneys cannot stress enough how important it is that whatever you niche, you need an attorney to help you navigate through the complex process of state law and local regulation. Failure to do so can end up costing you a substantial sum in the long run.

Although it seems everyone is finding a niche in the cannabis market, there are some main umbrellas under which most of these operations fall:

  • Cultivation
  • Infused products
  • Retail sales

Grow operations tend to be heavily regulated, require large upfront investment and horticultural background. Note too that Proposition 64 requires that you be totally compliant with the Bureau of Marijuana Control (responsible for licensing and regulation of marijuana businesses in California) and that you be sure your licensing and compliance is fully intact before you begin operations. Failure to do so may result not only in shut down of your business, but also potentially criminal charges. Entrepreneurs wading into the L.A. marijuana industry have invested too much of their time, their money and creativity to leave these elements to chance.

If you have a marijuana facility that was already operating in compliance with local ordinances on or before Jan. 1, 2018, you are likely allowed to continue operation until such time as your license is approved or denied, per AB No. 266.

You should also know that dozens of California cities in the last year have updated or established new local policies on marijuana cultivation, manufacturing and retail. New changes are being made constantly. The favored recreational indulgence appears to be shifting – from alcohol to marijuana. This is noteworthy because the shift is likely ultimately to be the nail in the coffin for federal marijuana prohibition. The fervent support of the younger generation for the plant – in addition to a growing number of baby boomers relying on its medicinal properties – could mean that day will happen sooner than later.cannabis lawyer

As our marijuana lawyers in Los Angeles see it, cannabis prohibition is a pit from which the federal government will need to dig itself out.

Now, a new survey released from The Tylt (the largest and fastest-growing social polling and opinion platform among the youngest adult cohort), indicates it is likely to be increasingly difficult to hold off on the move for too much longer. Specifically, roughly 85 percent back legalized marijuana, and no longer buy into the lie that total prohibition is necessary to keep America’s youth safe. Most said the “War on Drugs” is a failed one and the “War Against Weed” is one that needs a complete overhaul. 

Another survey last year found millennials are causing beer sales in the U.S. to tank. Younger users get how dangerous alcohol is, while 9 in 10 said they believed marijuana to be safer. In fact, they don’t believe cannabis to be harmful at all. Almost 90 percent said marijuana has therapeutic benefits likely to be beneficial for public health. Millennials also have no problem with athletes using marijuana as an alternative to prescription pain medications (with almost all saying it was preferable to opioid painkillers).

Increasingly, a number of younger professionals are deciding that even though using alcohol socially can be enjoyable, it’s generally not worth the calories – or the hangovers and embarrassing lack of control (something they need not deal with when using marijuana). Instead, they are smoking the herb occasionally and for pain taking candies and other edibles with cannabidiol (aka CBD) which doesn’t intoxicate users. Many also like the fact the marijuana costs less than alcohol. A gram of marijuana on the street is about $18 versus an average of $6 for a beer at your local bar (though it depends on the city).

As it now stands, nine states (including California) plus Washington D.C. have legalized recreational marijuana. Many more states allow for medicinal marijuana and others allow products that don’t have psychoactive components and help relieve muscle pain or anxiety. Decriminalization in some regions has relaxed attitudes about it generally, especially among youth. In fact, a poll conducted by Yahoo News last year revealed most milennials used marijuana socially, though only a quarter of them just smoke it.

Whereas 2 percent of high school seniors used marijuana daily in 1992, that figure jumped to 6 percent by 2017. (Certainly, we aren’t suggesting that high schoolers use the drug unless there is a medically approved reason to do so. Still these type of polls give us insight into trends. Meanwhile when we look at alcohol use, a poll by the Monitoring the Future Study of some 50,000 teens and younger adults revealed last year the number of college students who consume alcohol daily fell from 6.5 percent in 1980 to 2.2 percent in 2017.

Marijuana attorneys know this is also opening up a number of new markets for marijuana businesses. Those looking to break into possibly new markets with this information should discuss the legal factors they will need to carefully navigate with an experienced L.A. marijuana business attorney. Recreational cannabis is now a $6 billion industry – and apparently growing. These include products like “cannabis-infused sparkling tonic” which is sold in L.A., where many people are seeking low-dose cannabis products.

Wild Wild West of Marijuana Businesses Coming to an End

A major part of the work our legal team is involved with includes helping marijuana businesses establish themselvescannabis business while remaining in compliance with local and state regulations and laws. What happens, though, when a company is found to be in violation of one of those rules? Many businesses are beginning to find out as authorities ramp up efforts to wrangle illegal, unlicensed, and non-compliant marijuana operations in California. Recently more than 500 people were charged with misdemeanors in Los Angeles for their participation in illegal activity at 105 marijuana businesses in the city.

Those charged could face up to six months in jail and a $1,000 in fines for operating marijuana businesses without a license. The crackdown included not only dispensaries, but also extraction labs, cultivation sites, and delivery services, according to Los Angeles Times. Judges have been hearing cases associated with this series of investigations since May, and arraignments will carry into the end of October. So far, 21 have pleaded no contest or guilty and 11 have been dismissed. Other violations included not following security locations or not following rules regarding the business’s location, such as being too close to a school. With the proper future licensing and guidance, some of these businesses could still have a future, but major infractions like location will mean some will have to practically start over from scratch if they hope to continue in the industry.
Many have argued excess regulation, monstrously high taxes, and difficulty acquiring licensing have driven marijuana business owners to operate without being in full compliance. In some areas, after state and local taxes are combined, the amount cannabis product is being taxed is up to 50 percent. Business owners who had licenses back when just medical marijuana was legal in California found themselves having to reapply for licenses once the Medicinal and Adult-Use Cannabis Regulation and Safety Act was passed, consolidating guidelines for both medical and recreational marketplaces. Some struggled to align with the new law, even though they had already had been operating for years. While our skilled L.A. marijuana business lawyers agree there is too much red tape holding local business owners back, we also know that citing burdensome rules is not an affirmative defense in court should you get busted.

As Los Angeles City Attorney Mike Feuer has pointed out, clamping down on unregulated and illegal activity is not just about punishing non-compliant businesses. They, too, are facing the same challenges as all of the other businesses, but additionally must compete with operators who are padding out their bottom line by cutting corners. “Think About the Children” Goes Both Ways When It Comes to Marijuana

The issue of children and marijuana protections arose once again in the form of a proposed bill from Californiamedical marijuana Senator Jean Fuller (R-Bakersfield). The senator wanted to get on the books more concrete ramifications for dispensaries who sold marijuana to underage clients. The bill proposed a tiered system in which first offenders would receive a 15-day license suspension, second-time offenders within a three-year period would receive a 25-day suspension, and a third offense in three years would lead to a full license revocation. SB-1451, however, was vetoed by Gov. Jerry Brown, who called the bill “not necessary,” according tot a report from High Times. Gov. Brown pointed to the Bureau of Cannabis Control and cited their power to suspend or revoke licenses based on these exact kinds of violations and said he would rather the bureau be able to use their own discretion in determining punishment.

In the numerous discussions surrounding the issue of cannabis laws in California and other states across the country, there has been an extraordinary amount of focus on children. Can they be recommended marijuana by a doctor? What is the punishment for selling to a minor? How can marijuana businesses advertise in a way that would not be seen by or not be appealing to children? How do we make the packaging child safe? How does cannabis affect developing brains and bodies? How far should a business be located from schools? The list goes on and on, and many of these issues can be addressed simply with the guidance of a skilled marijuana legal counsel.Some of these questions are practical, common sense measures that must be taken seriously in the development of a marketplace that revolves around a controlled substance. Others are strawman arguments used to inject old-school fear tactics in order to derail any conversation about marijuana. “Think about the children” has long been a crutch on many issues in which there is not a strong enough argument on one side of the aisle. No one is against child safety, so implying that one side is not thinking of the safety of children is a sure way to win some easy points. We are currently seeing this argument play out in debates over whether marijuana delivery services should be allowed to bring product to private residences in cities with sales bans. One would think a child would be whisked away into a life of crime and drugs at the site of a marijuana delivery van the way some cannabis attackers paint the picture.

We’re finally seeing some sanity prevail, though, particularly in regards to medical marijuana and children with debilitating disorders. SB-1127, which would allow parents to administer cannabis-based medicines to their children on school grounds, is awaiting the governor’s signature. Currently, parents have to remove their child from school property to give them such medication and then bring them back to school, a terribly disruptive process. Furthermore, a discussion about cannabis and children simply cannot occur without noting that the absolute only marijuana-based medicine so far approved by U.S. Food & Drug Administration is one designed specifically for children with severe forms of epilepsy. This makes these children the most legitimized users of marijuana in the entire country. It’s safe to say if a family with an epileptic child lived in an area of California cut off from easy access to dispensaries, they would be pretty excited to see that delivery truck coming down their street with their much-needed medicine.

Workplace Deaths Go Down with Access to Medical Marijuana … By a Lot

Recent research out of American University, Colorado State University, and Montana State University delved into a medical marijuanacorrelation between workplace fatalities and the legalization of medical marijuana, and the discoveries could be surprising to many. The data points compiled fly in the face of anti-marijuana rhetoric that has been peddled as “common sense” for decades and show, in fact, a sharp decline in fatal workplace accidents as access to medical marijuana increases. The research is set to be published in The International Journal of Drug Policy, and according to a report from Colorado Springs Independent, the connection the research demonstrated between continuous decreases in fatalities in the workplace and medical marijuana is compelling.

Researchers compiled data from 1992 to 2015, providing a set that included the several years leading up to the passage of the Compassionate Use Act of 1996, which legalized medical marijuana in California, making it the first state to do so. The study followed other states as well and found that deaths from workplace accidents would drop about 34 percent after medical marijuana had been legal in that state for five years. The connection was most notable in the age group of 25- to 44-year-olds, which demonstrated a 19.8 percent reduction.
It was unclear what researchers would uncover going into the study given that there had never been an opportunity to collect this kind of data before. Additionally, it would seem reasonable that introducing a drug into society that had the potential for impairment could lead to an increase of incidents on the job, leading to more fatal accidents. Now that the numbers are demonstrating an opposite effect, however, we have an opportunity to learn more about cannabis and its effects.

One possible cause is what researchers call substitution theory. Our experienced Orange County medical marijuana lawyers can explain, substitution theory in simply when one factor in an observed setting is replaced by another. This, as it turns out, happens frequently when medical marijuana is introduced into an area, most significantly when chronic pain is a condition in which the state at-hand allows marijuana as a treatment. Frequently those with chronic pain turn to alcohol or strong, addictive painkillers, such as opioids.

If workers were turning to these substances during or before their shifts, the effects could be extremely negative, with impairments so severe it could easily lead to a fatal accident. If workers were to substitute these extreme forms of pain management with something like cannabis, they might experience some impairment for a limited time, but, as it’s turning out, not to the same effect of other previously more accessible substances. Of particular note is the use of CBD, in which patients would reap some of the benefits of cannabis without the sensation of feeling high. CBD does not have the psychoactive compounds of its cannabis sister THC, and therefore makes a very practical solution for those who need help with fewer impairment concerns. Ease of access also seemed to play a role, with significant drops in fatal accidents in areas where collective cultivation was permitted.

No one denies the need to set up common sense rules and structure around the use of cannabis, similarly to alcohol. The heavy-handed nature by which these rules have been handled, though, is clearly the aftermath of deep-seated propaganda and not in the reality of the dangers of this drug. In light of emerging data, our legal team hopes to see California join other states that have stepped up to protect the rights of workers who consume cannabis off-the-clock.
